Top-Paid Group Election. In determining who is a Highly Compensated Employee, the Employer makes the Top-Paid Group election. The effect of this election is that an Employee (who is not a 5% owner at any time during the determination year or the look-back year) who earned more than $80,000, as indexed for the look-back year, is a Highly Compensated Employee if the Employee was in the Top-Paid Group for the look-back year. This election is applicable for the Plan Year in which this Plan is effective.

Top-Paid Group Election. If elected in the Adoption Agreement, an Employee is in the top-paid group for any year if the Employee is in the group consisting of the top 20 percent of the Employees of the Employer when ranked on the basis of Compensation paid to Employees during such year. For purposes of determining the number of Employees in the Top-Paid Group, Employees described in section 414(q)(5) of the Code and 1.414(q)-1T of the Treasury Regulations are excluded. Employees with Compensation exceeding the dollar amount specified in Code Section 414(q)(1)(B)(i) adjusted pursuant to Code Section 415(d) shall be considered Highly Compensated Employees only if they are in the top paid group (the top 20% of Employees ranked by Compensation).
