Township Surety Requirements. Prior to the Town Board’s execution of this Developer’s Agreement, the Developer will provide the Township with an irrevocable letter of credit (or other surety as approved by the Township Attorney) as security that the obligations of the Developer to the Township under this Agreement shall be performed. Said letter of credit or surety shall be in the amount of $137,497.50 representing the sum of 150% of the estimated cost of the Township’s Infrastructure Improvements as determined by the Township Engineer. Said letter of credit or surety must meet the approval of the Township Attorney as to form and issuing bank (the issuing bank must be an FDIC insured bank located within 100 miles of Southside Township) and must be available in its entirety to fulfill the obligations of the Developer under this Agreement. The letter of credit to the Township shall contain language requiring its automatic annual renewal as set forth below. The letter of credit shall automatically renew for successive one-year terms unless, at least forty-five (45) days prior to the next annual renewal date (which shall be December 31 of each calendar year), the financial institution issuing the letter of credit delivers written notice to the party requiring the security that it intends to modify the terms of, or cancel, this letter of credit. Township Surety Requirements. Prior to the Town Board’s consideration of this developer’s Agreement, the Developer will provide the Township with an irrevocable letter of credit (or other surety as approved by the Township Attorney) as security that the obligations of the Developer under this Agreement shall be performed. Said letter of credit or surety shall be in the amount of $ representing the sum of 125% of the estimated cost of the Infrastructure Improvements as determined by the Township Engineer. Said letter of credit or surety must meet the approval of the Township Attorney as to form and issuing bank. The letter of credit to the Township shall be renewed prior to December 31, of each calendar year, by the Developer unless cancellation of the letter of credit is approved by the Township.

  • City Requirements Design, construction, materials, sizing, other specifications, permitting, inspections, testing, documentation and furnishing of as-built drawings, and acceptance of completed infrastructure shall be in accordance with City Requirements. Design and construction shall be by professionals licensed in the state of North Carolina to do the relevant work. City approval of the design of the Improvements shall be required prior to construction, as set forth in City Requirements. If Developer is connecting to the County sewer system, the City may require Developer to furnish the contract providing for such connection.

  • Safety Requirements 18.1.1 The Concessionaire shall comply with the provisions of this Agreement, Applicable Laws and Applicable Permits and conform to Good Industry Practice for securing the safety of the Users.
