County Surety Requirements. Prior to the County Board’s execution of this Developer’s Agreement, the Developer will provide the County with an irrevocable letter of credit (or other surety as approved by the County Attorney) as security that the obligations of the Developer to the County under this contract shall be performed. Said letter of credit or surety shall be in the amount of $112,500 representing the sum of 150% of the estimated cost of the County’s Infrastructure Improvements as determined by the County Engineer and estimated cost of stormwater improvements and erosion and sediment control. Said letter of credit or surety must meet the approval of the County Attorney as to form and issuing bank (the issuing bank must be an FDIC insured bank located within 100 miles of Southside Township) and must be available in its entirety to fulfill the obligations of the Developer under this Agreement. The letter of credit to the County shall contain language requiring its automatic annual renewal as set forth below. The letter of credit shall automatically renew for successive one-year terms unless, at least forty-five (45) days prior to the next annual renewal date (which shall be December 31 of each calendar year), the financial institution issuing the letter of credit delivers written notice to the party requiring the security that it intends to modify the terms of, or cancel, this letter of credit. County Surety Requirements. Unless otherwise agreed to by the County, the Developer shall also submit an irrevocable letter of credit (or other surety as approved by the County Attorney) to Cass County prior to the Cass County Board’s consideration of this developer’s agreement. The letter of credit shall act as security that the obligations of the Developer under this contract shall be performed. Said letter of credit or surety shall be in the amount of $ representing the sum of 125% of the estimated eminent domain costs as determined by Cass County. Said letter of credit or surety must meet the approval of the County attorney as to form and issuing bank. The letter of credit to the County shall be renewed prior to December 31, of each calendar year, by the Developer unless cancellation of the letter of credit is approved by the County.

  • Safety Requirements 18.1.1 The Concessionaire shall comply with the provisions of this Agreement, Applicable Laws and Applicable Permits and conform to Good Industry Practice for securing the safety of the Users. In particular, the Concessionaire shall develop, implement and administer a surveillance and safety program for providing a safe environment on or about the Project, and shall comply with the safety requirements set forth in Schedule-L (the “Safety Requirements”).

  • Federal Medicaid System Security Requirements Compliance Party shall provide a security plan, risk assessment, and security controls review document within three months of the start date of this Agreement (and update it annually thereafter) in order to support audit compliance with 45 CFR 95.621 subpart F, ADP System Security Requirements and Review Process.

  • Georgia Security and Immigration Compliance Act Requirements No bid will be considered unless the Contractor certifies its compliance with the Immigration reform and Control Act of 1986 (IRCA), D.L. 99-603 and the Georgia Security Immigration Compliance Act OCGA 13-10-91 et seq. The Contractor shall execute the Georgia Security and Immigration Compliance Act Affidavit, as found in Section 7 of the Construction Contract. Contractor also agrees that it will execute any affidavits required by the rules and regulations issued by the Georgia Department of Audits and Accounts. If the Contractor is the successful bidder, contractor warrants that it will include a similar provision in all written agreements with any subcontractors engaged to perform services under the Contract.

  • Accessibility Requirements Under Tex. Gov’t Code Chapter 2054, Subchapter M, and implementing rules of the Texas Department of Information Resources, the System Agency must procure Products and services that comply with the Accessibility Standards when those Products are available in the commercial marketplace or when those Products are developed in response to a procurement solicitation. Accordingly, Grantee must provide electronic and information resources and associated Product documentation and technical support that comply with the Accessibility Standards.

  • Health and Safety Requirements The Contractor and his subcontractors ensure at all times compliance with safety regulations imposed by any Act of Parliament, ordinance or any regulation or by¬law of any local or statutory authority. Occupational Health and Safety Act (Act of 1993-Section 37) The Contractor shall comply with:  The Occupational Health and Safety Xxx, 0000, and all Regulations made there under;  All Eskom Safety and Operating Procedures listed in this Works Information. Eskom may, at any stage during the currency of this agreement, be entitled to:  Do safety audits at the Contractor’s premises, its work-places and on its employees;  Refuse any employee, sub-contractor or agent of the Contractor access to its premises if such person has been found to commit any unlawful act or any unsafe working practice or is found to be not authorised or qualified in terms of the Act;

  • Eligibility Requirements The Trustee hereunder shall at all times (i) be a corporation or association having its principal office in a state and city acceptable to the Seller, organized and doing business under the laws of such state or the United States of America, authorized under such laws to exercise corporate trust powers, having a combined capital and surplus of at least $50,000,000, or shall be a member of a bank holding system, the aggregate combined capital and surplus of which is at least $50,000,000, provided that its separate capital and surplus shall at all times be at least the amount specified in Section 310(a)(2) of the Trust Indenture Act of 1939, (ii) be subject to supervision or examination by federal or state authority and (iii) have a credit rating or be otherwise acceptable to the Rating Agencies such that neither of the Rating Agencies would reduce their respective then current ratings of the Certificates (or have provided such security from time to time as is sufficient to avoid such reduction) as evidenced in writing by each Rating Agency. If such corporation or association publishes reports of condition at least annually, pursuant to law or to the requirements of the aforesaid supervising or examining authority, then for the purposes of this Section the combined capital and surplus of such corporation or association shall be deemed to be its combined capital and surplus as set forth in its most recent report of condition so published. In case at any time the Trustee shall cease to be eligible in accordance with the provisions of this Section, the Trustee shall resign immediately in the manner and with the effect specified in Section 8.08.
