Transaction and Closing Costs. The Developer shall pay the premium for an ALTA Owner’s Policy insuring the Developer interest in the Property subject only to any permitted exceptions and such other exceptions as may be caused by Developer (such as the lien of a Security Financing Interest) (collectively the “Title Policies”) (including title endorsements) in excess thereof. All other costs of escrow (including, without limitation, any Escrow Holder’s fee, costs of title company document preparation, recording fees, and transfer tax) shall be paid by the Developer. These costs borne by the Developer shall be in addition to the Land Payment.
