Common use of Transfer of Donation Clause in Contracts

Transfer of Donation. Once leave is donated, it shall not be returned. Donated leave is paid at the rate of pay of the employee for whom the leave is donated no matter which employee donates the leave. Once an employee qualifies for another leave benefit such as Long-Term Disability, Workers Compensation, or Disability Retirement with one of the retirement systems (School Employees Retirement System), the employee may no longer receive or use donated leave. At no time will an employee be on donated leave for more than 180 days consecutively. Employees receiving donated leave will be considered in a pay status and shall accrue all benefits for which they normally would be eligible.
