Common use of Transfer of Employees Out of the Bargaining Unit Clause in Contracts

Transfer of Employees Out of the Bargaining Unit. When the parties are made aware that employees will be transferred out of the Public Service bargaining unit to a corporation, board, agency, or commission, a joint Employer/Union Committee shall immediately be established. The Committee shall be established to facilitate the orderly transfer of employees. Where such transfers occur, those transferred employees will be recognized as in-service applicants when applying for regular positions in Government for a period of two years from the effective date of the transfer. This Clause does not cover secondment of employees.
