Transfer outside of the Bargaining Unit. (a) A nurse who is transferred to a position outside of the bargaining unit for a period of not more than three (3) months, or is seconded to teach for an academic year shall not suffer any loss of seniority, service or benefits. A nurse who is transferred to a position outside of the bargaining unit for a period of more than three (3) months, but not more than one (1) year shall retain, but not accumulate, her or his seniority held at the time of the transfer. In the event the nurse is returned to a position in the bargaining unit, she or he shall be credited with seniority held at the time of transfer and resume accumulation from the date of her or his return to the bargaining unit. The union will be provided notice prior to the commencement of the transfers mentioned above. A nurse must remain in the bargaining unit for a period of at least five (5) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer.
(b) In the event that a nurse is transferred to a position outside of the bargaining unit for a period in excess of one (1) year, she or he will lose all seniority held at the time of transfer. In the event the nurse is returned to a position in the bargaining unit, the nurse's seniority will accrue from the date of her or his return to the bargaining unit.
(c) It is understood and agreed that a nurse may decline such offer to transfer and that the period of time referred to above may be extended by agreement of the parties.
(d) The Hospital agrees that it will not make work assignments that violate the purpose and intent of this provision. The Hospital will advise the local Union of the names of any nurses performing the duties of positions outside of the bargaining unit pursuant to Articles 10.11 and/or 19.04 (b), the date the assignment commenced, the area of assignment and the duration of such assignments.
(e) A nurse who accepts a transfer under Article 10.11 will not be required to pay union dues for any complete calendar month during which no bargaining unit work is performed.

The selection or appointment of an employee to a supervisory position or any other type of position not subject to this agreement, is not governed by this agreement, but if an employee who has been transferred back to a position in the bargaining unit, then the service accumulated during the transfer shall be counted as service for the purpose of determining seniority, provided he/she has not been transferred out of the bargaining unit for a period exceeding three (3) months. In the event the Company at its sole discretion elects to transfer a non bargaining unit employee to the bargaining unit, such employee will be classified in an entry level position without seniority and will be deemed to be a new employee who is required to serve the probationary period under Article 9.02, notwithstanding anything that may be to the contrary in the collective agreement.

An employee who is transferred temporarily to a position outside of the bargaining unit for a period of more than three (3) months, but not more than one (1) year shall retain, but not accumulate, her or his seniority held at the time of the transfer. Transfer outside of the Bargaining Unit. (a) A nurse who has been requested to substitute temporarily in a classification that is excluded from the bargaining unit may refuse to do so. If she/he consents she/he shall be deemed to be covered by the Collective Agreement, but shall be compensated in accordance with the excluded classification. In the event that a nurse is transferred out of the bargaining unit, as above, for a period of three (3) months and is returned to a position in the bargaining unit, she/he will not suffer any loss of seniority, service or benefits. A nurse who is transferred temporarily to a position outside of the bargaining unit for a period of more than three (3) months but not more than one (1) year, with the option to extend if mutually agreed upon by both parties, shall retain but not accumulate, her or his seniority held at the time of the transfer. In the event the employee is returned to the bargaining unit, she/he shall be credited with seniority held at the time of the transfer and resume accumulation from the date of her or his return to the bargaining unit. Where the nurse is transferred temporarily for an employee who is off on pregnancy and/or parental leave, this temporary position can be extended to a maximum of eighteen (18) months. Transfer outside of the Bargaining Unit. (a) A Clinical Educator who is transferred to a position outside of the bargaining unit for a period of not more than three (3) months, or is seconded to teach for an academic year shall not suffer any loss of seniority, service or benefits.

(a) A nurse who is transferred to a position outside of the bargaining unit for a period of not more than eight (8) months or is seconded to teach for an academic year shall not suffer any loss of seniority, service or benefits. A nurse who is transferred to a position outside of the bargaining unit for a period of not more than one (1) year or in the case of pregnancy or parental leave up to eighteen (18) months shall, subject to (d) below, retain, but not accumulate, her or his seniority held at the time of the transfer. In the event the nurse is returned to a position in the bargaining unit, she or he shall be credited with seniority held at the time of transfer and resume accumulation from the date of her or his return to the bargaining unit. A nurse must remain in the bargaining unit for a period of at least three (3) months before transferring out of the bargaining unit again or she or he will lose all seniority held at the time of the subsequent transfer.
(b) In the event that a nurse is transferred to a position outside of the bargaining unit for a period in excess of one (1) year, she or he will lose all seniority held at the time of transfer. In the event the nurse is returned to a position in the bargaining unit, the nurse's seniority will accrue from the date of her or his return to the bargaining unit.
(c) It is understood and agreed that a nurse may decline such offer to transfer and that the period of time referred to above may be extended by agreement of the parties.
(d) The Health Centre will advise the local Association of the names of any nurses performing the duties of positions outside of the bargaining unit pursuant to Article 10.11 and/or 19.04 (b), the date the assignment commenced, the area of assignment and the duration of such assignments.
(i) The assignment of patient care duties, including the delegation or direction of duties by members of the bargaining unit to other health care providers, shall be in accordance with the Regulated Health Professions Act and related statutes and regulations and in accordance with the guidelines established by the College of Nurses of Ontario from time to time and any Employer policy related thereto shall meet those requirements.
(ii) The Parties shall engage in meaningful discussions respecting implementing staffing complements based on the benchmarks in the Pricewaterhouse Coopers report. The Parties shall meet within four
