Common use of Transport Clause in Contracts

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to TWTC for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that TWTC uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTC. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC to connect such interoffice facilities to equipment designated by TWTC, including but not limited to, TWTC’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 47 C.F.R. §§ 51.311, 51.319, and Section 47 U.S.C. § 251(c)(3) of the Act ), to interoffice transmission facilities described in this Section 6 on an unbundled basis to TWTC US LEC for the provision of a qualifying serviceQualifying and Non-Qualifying Service, as set forth herein, so long as the facilities is not used solely for Non-Qualifying Services. 6.1.1.1 Dedicated Transport is defined in 47 C.F.R. 51.319(e) as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that TWTC US LEC uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. To the extent that BellSouth has local switching equipment, as defined by the FCC’s rules, “reverse collocated” in a non- incumbent LEC premises, the transmission path from this point back to the BellSouth wire center shall constitute Dedicated Transport. 6.1.1.2 Dark Fiber Transport is inactivated optical Dedicated Transport as defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA;in 6.1.1.1 above. 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCUS LEC. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC US LEC exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC US LEC to connect such interoffice facilities to equipment designated by TWTCUS LEC, including but not limited to, TWTCUS LEC’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC US LEC to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCBAK. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC BAK exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC BAK to connect such interoffice facilities to equipment designated by TWTCBAK, including but not limited to, TWTCBAK’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC BAK to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCRuddata. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Ruddata exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Ruddata to connect such interoffice facilities to equipment designated by TWTCRuddata, including but not limited to, TWTCRuddata’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Ruddata to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCDeland Actel. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Deland Actel exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Deland Actel to connect such interoffice facilities to equipment designated by TWTCDeland Actel, including but not limited to, TWTCDeland Actel’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Deland Actel to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCXxxx. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Xxxx exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Xxxx to connect such interoffice facilities to equipment designated by TWTCXxxx, including but not limited to, TWTC’s Xxxx’x collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Xxxx to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCGateway. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Gateway exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Gateway to connect such interoffice facilities to equipment designated by TWTCGateway, including but not limited to, TWTCGateway’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Gateway to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCWorldxChange. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC WorldxChange exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC WorldxChange to connect such interoffice facilities to equipment designated by TWTCWorldxChange, including but not limited to, TWTCWorldxChange’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC WorldxChange to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCExcel. 6.1.2 BellSouth shall:: AMENDMENT EXHIBIT 1 6.1.2.1 Provide TWTC Excel exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Excel to connect such interoffice facilities to equipment designated by TWTCExcel, including but not limited to, TWTCExcel’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Excel to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCAmeriMex. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC AmeriMex exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC AmeriMex to connect such interoffice facilities to equipment designated by TWTCAmeriMex, including but not limited to, TWTCAmeriMex’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC AmeriMex to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to TWTC FPB for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that TWTC FPB uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to TWTC EZ Phone for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that TWTC EZ Phone uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is Transport, defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCEZ Phone. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC EZ Phone exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC EZ Phone to connect such interoffice facilities to equipment designated by TWTCEZ Phone, including but not limited to, TWTCEZ Phone’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC EZ Phone to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCACN. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC ACN exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC ACN to connect such interoffice facilities to equipment designated by TWTCACN, including but not limited to, TWTCACN’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC ACN to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCBSE. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC BSE exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC BSE to connect such interoffice facilities to equipment designated by TWTCBSE, including but not limited to, TWTCBSE’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC BSE to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCNex- Phon. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Nex-Phon exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Nex-Phon to connect such interoffice facilities to equipment designated by TWTCNex-Phon, including but not limited to, TWTCNex- Phon’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Nex-Phon to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCCovista. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Covista exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Covista to connect such interoffice facilities to equipment designated by TWTCCovista, including but not limited to, TWTCCovista’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Covista to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCConnectNow!. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC ConnectNow! exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC ConnectNow! to connect such interoffice facilities to equipment designated by TWTCConnectNow!, including but not limited to, TWTCConnectNow!’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC ConnectNow! to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to TWTC ONS for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that TWTC ONS uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to TWTC Grande for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that TWTC Grande uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is Transport, defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCGrande. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Grande exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Grande to connect such interoffice facilities to equipment designated by TWTCGrande, including but not limited to, TWTCGrande’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Grande to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCTriarch Marketing. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Triarch Marketing exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Triarch Marketing to connect such interoffice facilities to equipment designated by TWTCTriarch Marketing, including but not limited to, TWTCTriarch Marketing’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Triarch Marketing to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCMyLineToo. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC MyLineToo exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC MyLineToo to connect such interoffice facilities to equipment designated by TWTCMyLineToo, including but not limited to, TWTCMyLineToo’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC MyLineToo to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to TWTCStarlink. 6.1.2 BellSouth shall: 6.1.2.1 Provide TWTC Starlink exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, TWTC Starlink to connect such interoffice facilities to equipment designated by TWTCStarlink, including but not limited to, TWTCStarlink’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, TWTC Starlink to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.
