Common use of Transport Clause in Contracts

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to ONS for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that ONS uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONS. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS to connect such interoffice facilities to equipment designated by ONS, including but not limited to, ONS’ collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSTelson. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Telson exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Telson to connect such interoffice facilities to equipment designated by ONSTelson, including but not limited to, ONS’ Telson’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Telson to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSMyLineToo. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS MyLineToo exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS MyLineToo to connect such interoffice facilities to equipment designated by ONSMyLineToo, including but not limited to, ONS’ MyLineToo’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS MyLineToo to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSGrande. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Grande exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Grande to connect such interoffice facilities to equipment designated by ONSGrande, including but not limited to, ONS’ Grande’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Grande to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSMetro Teleconnect. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Metro Teleconnect exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Metro Teleconnect to connect such interoffice facilities to equipment designated by ONSMetro Teleconnect, including but not limited to, ONS’ Metro Teleconnect’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Metro Teleconnect to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSMTS Communications. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS MTS Communications exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS MTS Communications to connect such interoffice facilities to equipment designated by ONSMTS Communications, including but not limited to, ONS’ MTS Communications’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS MTS Communications to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 47 C.F.R. §§ 51.311, 51.319, and Section 47 U.S.C. § 251(c)(3) of the Act ), to interoffice transmission facilities described in this Section 6 on an unbundled basis to ONS US LEC for the provision of a qualifying serviceQualifying and Non-Qualifying Service, as set forth herein, so long as the facilities is not used solely for Non-Qualifying Services. 6.1.1.1 Dedicated Transport is defined in 47 C.F.R. 51.319(e) as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that ONS US LEC uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. To the extent that BellSouth has local switching equipment, as defined by the FCC’s rules, “reverse collocated” in a non- incumbent LEC premises, the transmission path from this point back to the BellSouth wire center shall constitute Dedicated Transport. 6.1.1.2 Dark Fiber Transport is inactivated optical Dedicated Transport as defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA;in 6.1.1.1 above. 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSUS LEC. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS US LEC exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS US LEC to connect such interoffice facilities to equipment designated by ONSUS LEC, including but not limited to, ONS’ US LEC’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS US LEC to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSNexus. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Nexus exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Nexus to connect such interoffice facilities to equipment designated by ONSNexus, including but not limited to, ONS’ Nexus’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Nexus to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSEZ Phone. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS EZ Phone exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS EZ Phone to connect such interoffice facilities to equipment designated by ONSEZ Phone, including but not limited to, ONS’ EZ Phone’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS EZ Phone to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSCBX One-Stop. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS CBX One-Stop exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS CBX One-Stop to connect such interoffice facilities to equipment designated by ONSCBX One-Stop, including but not limited to, ONS’ CBX One-Stop’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS CBX One-Stop to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSSPARDI. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS SPARDI exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS SPARDI to connect such interoffice facilities to equipment designated by ONSSPARDI, including but not limited to, ONS’ SPARDI’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS SPARDI to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to ONS AmTel for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that ONS AmTel uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is Transport, defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSDPI Teleconnect. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS DPI Teleconnect exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS DPI Teleconnect to connect such interoffice facilities to equipment designated by ONSDPI Teleconnect, including but not limited to, ONS’ DPI Teleconnect’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS DPI Teleconnect to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to ONS COMTECH21 for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that ONS COMTECH21 uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is Transport, defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSCOMTECH21. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS COMTECH21 exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS COMTECH21 to connect such interoffice facilities to equipment designated by ONSCOMTECH21, including but not limited to, ONS’ COMTECH21’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS COMTECH21 to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSBAK. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS BAK exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS BAK to connect such interoffice facilities to equipment designated by ONSBAK, including but not limited to, ONS’ BAK’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS BAK to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSExcel. 6.1.2 BellSouth shall:: AMENDMENT EXHIBIT 1 6.1.2.1 Provide ONS Excel exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Excel to connect such interoffice facilities to equipment designated by ONSExcel, including but not limited to, ONS’ Excel’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Excel to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSNationsLink. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS NationsLink exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS NationsLink to connect such interoffice facilities to equipment designated by ONSNationsLink, including but not limited to, ONS’ NationsLink’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS NationsLink to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSStarlink. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Starlink exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Starlink to connect such interoffice facilities to equipment designated by ONSStarlink, including but not limited to, ONS’ Starlink’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Starlink to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSCovista. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Covista exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Covista to connect such interoffice facilities to equipment designated by ONSCovista, including but not limited to, ONS’ Covista’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Covista to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSABC Telcom. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS ABC Telcom exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS ABC Telcom to connect such interoffice facilities to equipment designated by ONSABC Telcom, including but not limited to, ONS’ ABC Telcom’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS ABC Telcom to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to ONS Deland Actel for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that ONS Deland Actel uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSDeland Actel. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Deland Actel exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Deland Actel to connect such interoffice facilities to equipment designated by ONSDeland Actel, including but not limited to, ONS’ Deland Actel’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Deland Actel to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to ONSComm South. 6.1.2 BellSouth shall: 6.1.2.1 Provide ONS Comm South exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, ONS Comm South to connect such interoffice facilities to equipment designated by ONSComm South, including but not limited to, ONS’ Comm South’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, ONS Comm South to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.
