Common use of Transport Clause in Contracts

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to NTBS for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that NTBS uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBS. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS to connect such interoffice facilities to equipment designated by NTBS, including but not limited to, NTBS’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSGrande. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS Grande exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS Grande to connect such interoffice facilities to equipment designated by NTBSGrande, including but not limited to, NTBSGrande’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS Grande to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSDeland Actel. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS Deland Actel exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS Deland Actel to connect such interoffice facilities to equipment designated by NTBSDeland Actel, including but not limited to, NTBSDeland Actel’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS Deland Actel to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSICG. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS ICG exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS ICG to connect such interoffice facilities to equipment designated by NTBSICG, including but not limited to, NTBSICG’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS ICG to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSABC Telcom. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS ABC Telcom exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS ABC Telcom to connect such interoffice facilities to equipment designated by NTBSABC Telcom, including but not limited to, NTBSABC Telcom’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS ABC Telcom to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSSPARDI. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS SPARDI exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS SPARDI to connect such interoffice facilities to equipment designated by NTBSSPARDI, including but not limited to, NTBSSPARDI’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS SPARDI to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSConnectNow!. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS ConnectNow! exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS ConnectNow! to connect such interoffice facilities to equipment designated by NTBSConnectNow!, including but not limited to, NTBSConnectNow!’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS ConnectNow! to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to NTBS Starlink for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that NTBS Starlink uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSStarlink. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS Starlink exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS Starlink to connect such interoffice facilities to equipment designated by NTBSStarlink, including but not limited to, NTBSStarlink’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS Starlink to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to NTBS Nexus for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that NTBS Nexus uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is Transport, defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSNexus. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS Nexus exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS Nexus to connect such interoffice facilities to equipment designated by NTBSNexus, including but not limited to, NTBSNexus’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS Nexus to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSAmTel. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS AmTel exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS AmTel to connect such interoffice facilities to equipment designated by NTBSAmTel, including but not limited to, NTBSAmTel’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS AmTel to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSTWTC. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS TWTC exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS TWTC to connect such interoffice facilities to equipment designated by NTBSTWTC, including but not limited to, NTBSTWTC’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS TWTC to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSVertex. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS Vertex exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS Vertex to connect such interoffice facilities to equipment designated by NTBSVertex, including but not limited to, NTBSVertex’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS Vertex to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSFeroNetworks. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS FeroNetworks exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS FeroNetworks to connect such interoffice facilities to equipment designated by NTBSFeroNetworks, including but not limited to, NTBSFeroNetworks’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS FeroNetworks to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSExcel. 6.1.2 BellSouth shall:: AMENDMENT EXHIBIT 1 6.1.2.1 Provide NTBS Excel exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS Excel to connect such interoffice facilities to equipment designated by NTBSExcel, including but not limited to, NTBSExcel’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS Excel to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to NTBS ▇▇▇▇ for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that NTBS ▇▇▇▇ uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is Transport, defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Transport. 6.1.1 BellSouth shall provide nondiscriminatory access, in accordance with FCC Rules 51.311, 51.319, and Section 251(c)(3) of the Act to interoffice transmission facilities described in this Section 6 on an unbundled basis to NTBS TeleConex for the provision of a qualifying service, as set forth herein. 6.1.1.1 Dedicated Transport is defined as BellSouth’s interoffice transmission facilities, dedicated to a particular customer or carrier that NTBS TeleConex uses for transmission between wire centers or switches owned by BellSouth and within the same LATA. 6.1.1.2 Dark Fiber Transport is Transport, defined as BellSouth’s optical transmission facilities without attached signal regeneration, multiplexing, aggregation or other electronics, between wire centers or switches owned by BellSouth and within the same LATA; 6.1.1.3 Common (Shared) Transport is Transport, defined as transmission facilities shared by more than one carrier, including BellSouth, between end office switches, between end office switches and tandem switches, and between tandem switches, in BellSouth’s network. Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSTeleConex. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS TeleConex exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS TeleConex to connect such interoffice facilities to equipment designated by NTBSTeleConex, including but not limited to, NTBSTeleConex’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS TeleConex to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSBSE. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS BSE exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS BSE to connect such interoffice facilities to equipment designated by NTBSBSE, including but not limited to, NTBSBSE’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS BSE to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.

Where BellSouth Network Elements are connected by intraoffice wiring, such wiring is provided as part of the Network Element and is not Common (Shared) Transport. 6.1.1.3.1 Notwithstanding any other provision of this Agreement, BellSouth will only provide unbundled access to Common (Shared) Transport to the extent BellSouth is required to provide and is providing unbundled Local Circuit Switching to NTBSACI. 6.1.2 BellSouth shall: 6.1.2.1 Provide NTBS ACI exclusive use of Dedicated Transport to a particular customer or carrier, or shared use of the features, functions, and capabilities of interoffice transmission facilities shared by more than one customer or carrier; 6.1.2.2 Provide all technically feasible features, functions, and capabilities of the transport facility; 6.1.2.3 Permit, to the extent technically feasible, NTBS ACI to connect such interoffice facilities to equipment designated by NTBSACI, including but not limited to, NTBSACI’s collocated facilities; and 6.1.2.4 Permit, to the extent technically feasible, NTBS ACI to obtain the functionality provided by BellSouth’s digital cross-connect systems. 6.1.3 Technical Requirements of Common (Shared) Transport 6.1.3.1 Common (Shared) Transport provided on DS1, DS3, and STS-1 circuits shall at a minimum meet the performance, availability, jitter, and delay requirements specified for Central Office to Central Office (CO to CO) connections in the applicable industry standards.
