U. S. GOVERNMENT RESTRICTED RIGHTS. For solicitations issued before December 1, 1995 by the United States of America, its agencies and/or instrumentalities (the "Government"), other than the Department of Defense, the use, duplication or disclosure of the software and documentation provided to the Government under this Agreement shall be subject to the RESTRICTED RIGHTS as set forth in subparagraph (c)(1) and (2) of the Rights in Technical Data and Computer Software clause at 48 CFR 52.227-19. For solicitations issued before September 29, 1995 by the Department of Defense, the use, duplication or disclosure of the software and documentation provided under this Agreement shall be subject to the RESTRICTED RIGHTS as set forth in subparagraphs (c)(1)(ii) of the Commercial Computer Software - Restricted Rights clause at 48 CFR 252.227-7013. For solicitations issued by the Government on or after December 1, 1995 and the Department of Defense on or after September 29, 1995, the only rights provided in the software and documentation provided herein shall be those contained in this Agreement. U. S. GOVERNMENT RESTRICTED RIGHTS. The Software is commercial computer software subject to RESTRICTED RIGHTS. In accordance with 48 CFR 12.212 (Computer software) or DFARS 227.7202 (Commercial computer software and commercial computer software documentation), as applicable, the use, duplication, and disclosure of the Software by the United States of America, its agencies or instrumentalities is subject to the restrictions set forth in this Agreement.

Government is subject to restrictions as set forth in the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c) (1) and (2) of the Commercial Computer Software Restricted Rights at 48 CFR 52.227-19, as applicable. U. S. GOVERNMENT RESTRICTED RIGHTS. Notwithstanding anything to the contrary, any applicable Government regulations for the purchase or use of the Product(s) hereunder are solely based on FAR 52.244-6, Subcontracts for Commercial Items.
U. S. GOVERNMENT RESTRICTED RIGHTS. If you are the United States Government or are acquiring the right to access and use the Application on behalf of the United States Government, then the United States Government agrees that: (a) If the right to access and use the Application is acquired by or supplied to the Department of Defense (“DOD”), the Application shall be classified as “Commercial Computer Software” and the government is acquiring only “restricted rights” in the Application and its documentation, as defined in Clause 252.227-7013(c)(1) of the DFARS; (b) for any part of the United States Government other than DOD, the government’s rights in the Application and its documentation will be as defined in Clause 52.227-19(c)(2) of the FAR or, for NASA, in Clause 18-52.227-86(d) of the NASA Supplement to the FAR.
U. S. GOVERNMENT RESTRICTED RIGHTS. The AVAIL Software is provided with RESTRICTIVE RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions: if supplied to the Department of Defense (DoD), the Software is ''Commercial Computer Software'' and the Government acquires the Software with ''restricted rights,'' as defined in Clause 252.227-7013(c)(1) of the DFARS; if the Software is supplied to any other Government unit or agency, the Government's rights in the Software are defined in Clause 52.227-19(c)(2) of the FAR; but if the Software is supplied to NASA, the Government's rights are defined in Clause 18-52.227-86(d) of the NASA supplement to the FAR.
