Underground Storage Tank Disclosure. In accordance with the requirements of the D.C. Underground Storage Tank Management Act of 1990, as amended by the District of Columbia Underground Storage Tank Management Act of 1990 Amendment Act of 1992 (D.C. Code 5-995.1et. seq.) (the “Act”) and the D.C. Underground Storage Tank Regulations, 20 DCMR Chapters 66.68 (the “Regulations”), Seller hereby informs Purchaser that it is not aware of any “underground storage tank” as that term is defined in the Act and the Regulations on the Property. HOWEVER, SELLER HAS BEEN INFORMED THAT AN “UNDERGROUND STORAGE TANK” WAS REMOVED FROM THE PROPERTY ON NOVEMBER 6, 2002, AND THAT CERTAIN ADDITIONAL ACTION IS NECESSARY BEFORE THE D.C. DEPARTMENT OF ENVIRONMENT, UST DIVISION WILL ISSUE A “NO FURTHER ACTION” LETTER WITH RESPECT TO THIS MATTER. THIS MATTER IS ADDRESSED, AND IS BEING OR HAS BEEN REMEDIATED, AS SET FORTH IN SECTION III.G OF THE PUBLIC OFFERING STATEMENT AND EXHIBITS III-D-1, III-D-2 AND III-D-3 ATTACHED TO IT. INFORMATION PERTAINING TO THE UNDERGROUND STORAGE TANK AND ITS REMOVAL OF WHICH THE D. C. GOVERNMENT HAS RECEIVED NOTIFICATION IS ON FILE WITH THE D.C. DEPARTMENT OF CONSUMER AND REGULATORY AFFAIRS, ENVIRONMENTAL REGULATION ADMINISTRATION, UNDERGROUND STORAGE TANK BRANCH, 2100 XXXXXX XXXXXX XXXX, XX. AVENUE, S.E., WASHINGTON, D.C., TELEPHONE (000) 000-0000.

Underground Storage Tank Disclosure. Purchaser hereby acknowledges that, prior to entering into this Agreement, Seller made a disclosure to Purchaser with respect to any underground storage tanks located on the Property of which Seller has knowledge. The form of disclosure is set forth in Exhibit J (the “Underground Storage Tank Disclosure”).

Information pertaining to underground storage tanks and underground storage tank removals of which the D.C. Government has received notification is on file with the D.C. Department of Consumer and Regulatory Affairs, Environmental Regulation Administration, Underground Storage Tank Branch, 0000 Xxxxx Xxxxxx, XX, 0xx Xxxxx, Xxxxxxxxxx, X.X., telephone (000) 000-0000.
