Common use of Union Visitation Clause in Contracts

Union Visitation. ‌ Authorized representatives of the Union will be permitted to visit the premises of the Operator for the purpose of ascertaining that the provisions of this Agreement are being observed and/or conferring with workers covered by this Agreement during their non-work time and in break areas. Such visits shall not interfere with the operation of the nursing home or the performance of the workers’ duties and the Union Representative shall inform the Administrator or Director of Nursing of his/her visits prior to entering the nursing home’s premises. The Union will furnish in writing the name of the authorized representatives, and the Operator is obliged only for admission of such authorized representative. Operators shall not unreasonably deny access to employee break areas during all working hours for above-stated reasons.

Such visits shall not interfere with the operation of the nursing home or the performance of the workers’ duties and the Union Representative shall inform the Administrator or Director of Nursing of his/her visits prior to entering the nursing home’s premises. It is understood that certain unforeseen circumstances such as an emergency which may prevent access for representatives of the Union. The Union will furnish in writing the name of the authorized representatives, and the Operator Employer is obliged only for admission of such authorized representative. Operators The Employer shall not unreasonably deny access to employee break areas during all working hours for above-above stated reasons.
