Unique Procedures / Processes Necessary to Support ASDs. USDOT needs to identify the unique procedures / processes necessary to support ASD development, manufacture & installation and minimize the burden to the suppliers, installers, governance agencies or consumers to strengthen the business case for ASDs (e.g. device, function and system performance certification; security credential management; liability risk management). A refined Xxxxx fleet penetration and safety benefits analysis will be required to estimate whether or not the accelerated realization of safety benefits warrants the added costs to support ASDs deployment. USDOT Safety Policy Program Tracks affected: - Track 1 Communications Security & Infrastructure - Track 2 – Certification - Track 4 - Risk Allocation & Liability ASD Key Policy Issues Grouped: - USDOT needs to determine if any unique security process, procedures or other support necessary to accommodate the variety of ASD manufacturers and installers is justified by the increase in vehicle fleet penetration provided by the availability of ASDs (refined Xxxxx benefit analysis required). (Track 1 ASD Issue #1) - USDOT should assure the certification process for ASD’s is not so burdensome that it destroys the business case for market driven deployment. (Track 2 ASD Issue #6a) - USDOT should consider certification processes that reduce the risk and burden on smaller ASD suppliers by having a third party perform the evaluation and testing and explore through aftermarket supplier surveys whether type approval certification would lead to more aftermarket participation in populating the fleet with ASDs. (Track 4 ASD Issue #9)

  • Notification of Modifications of Licensed Materials From time to time Publisher may add, change, or modify portions of the Licensed Materials, or migrate the Licensed Materials to other formats. When such changes, modifications, or migrations occur, the Licensor shall give notice of any such changes to Licensee as soon as is practicable, but in no event less than sixty (60) days in advance of modification. Such a notice may also be given directly by the Publisher to the Licensee. If any of the changes, modifications, or migrations renders the Licensed Materials substantially less useful to the Licensee, the Participating Institutions or their Authorized Users, the Licensee may seek to terminate this Agreement for breach pursuant to the termination provisions of this Agreement in Section XI, below.

  • Procedures for Providing NP Through Full NXX Code Migration Where a Party has activated an entire NXX for a single Customer, or activated at least eighty percent (80%) of an NXX for a single Customer, with the remaining numbers in that NXX either reserved for future use by that Customer or otherwise unused, if such Customer chooses to receive Telephone Exchange Service from the other Party, the first Party shall cooperate with the second Party to have the entire NXX reassigned in the LERG (and associated industry databases, routing tables, etc.) to an End Office operated by the second Party. Such transfer will be accomplished with appropriate coordination between the Parties and subject to appropriate industry lead times for movements of NXXs from one switch to another. Neither Party shall charge the other in connection with this coordinated transfer.

This remedy, if effected, shall not constitute the sole remedy afforded the COUNTY for such falsity or breach, not shall it constitute a waiver of the COUNTY’s right to claim damages or otherwise refuse payment or to take any other action provided for by law or pursuant to this Agreement.

  • Effect of Addenda, Bulletins, and Change Orders No special implication, interpretation, construction, connotation, denotation, import, or meaning shall be assigned to any provision of the Contract Documents because of changes created by the issuance of any (1) Addendum, (2) Bulletin, or (3) Change Order other than the precise meaning that the Contract Documents would have had if the provision thus created had read originally as it reads subsequent to the (1) Addendum, (2) Bulletin, or (3) Change Order by which it was created.
