Type Approval. Prior to commencing commercial mass production of any China WORLDSPACE PC Cards and China WORLDSPACE Receivers, TONGSHI will submit to WORLDSPACE for its inspection: (i) a prototype of each PC card or receiver that TONGSHI proposes to manufacture, so that WORLDSPACE may confirm that such prototype PC card or receiver performs in accordance with the WORLDSPACE Format and the Technical Specifications; and (ii) the preliminary design specifications for such PC cards or receivers, including all circuit diagrams, blueprints (or equivalents thereof), component specifications (if WORLDSPACE requests) and overall specifications of such prototype PC card or receiver. If such prototype PC card or receiver successfully passes WORLDSPACE’s test, it will be deemed an approved “China WORLDSPACE PC Card” or “China WORLDSPACE Receiver,” as the case may be, under this Agreement. After a PC card or receiver has been qualified as a China WORLDSPACE PC Card or China WORLDSPACE Receiver, as the case may be, no changes may be made to the China WORLDSPACE PC Card or China WORLDSPACE Receiver except for those which are cosmetic in nature or which do not materially affect the function or quality of the China WORLDSPACE PC Card or China WORLDSPACE Receiver unless the PC card or receiver is resubmitted to WORLDSPACE for testing and WORLDSPACE confirms that this modified PC card or receiver continues to qualify as a China WORLDSPACE PC Card or China WORLDSPACE Receiver. All testing will be performed at WORLDSPACE’s then current testing rates. As of the Effective date of this Agreement, WORLDSPACE’s standard rates are as set forth in Appendix 8, but WORLDSPACE reserves the right to make reasonable changes to its rates with prior notification to TONGSHI. The testing fees for the first prototype PC card and the first prototype receiver to be tested are included in the license fee paid by TONGSHI to WORLDSPACE pursuant to Article 4.1.3 hereinafter.

Type Approval. Type approvals authorise the manufacture of pressure receptacles, tanks, battery-vehicles or MEGCs within the period of validity of that approval.
1.8.7.2.1 The applicant shall:
(a) In the case of pressure receptacles, place at the disposal of the relevant body representative samples of the production envisaged. The relevant body may request further samples if required by the test programme;
(b) In the case of tanks, battery-vehicles or MEGCs, give access to the prototype for type testing.
1.8.7.2.2 The relevant body shall:
(a) Examine the technical documentation specified in 1.8.
7.7.1 to verify that the design is in accordance with the relevant provisions of ADR, and the prototype or the prototype lot has been manufactured in conformity with the technical documentation and is representative of the design;
(b) Perform the examinations and witness the tests specified in ADR, to determine that the provisions have been applied and fulfilled, and the procedures adopted by the manufacturer meet the requirements;
(c) Check the certificate(s) issued by the materials manufacturer(s) against the relevant provisions of ADR;
(d) As applicable, approve the procedures for the permanent joining of parts or check that they have been previously approved, and verify that the staff undertaking the permanent joining of parts and the non-destructive tests are qualified or approved;
(e) Agree with the applicant the location and testing facilities where the examinations and necessary tests are to be carried out. The relevant body shall issue a type-examination report to the applicant.
1.8.7.2.3 Where the type satisfies all applicable provisions, the competent authority, its delegate or the inspection body, shall issue a type approval certificate to the applicant. This certificate shall contain:
(a) The name and address of the issuer;
(b) The name and address of the manufacturer and of the applicant when the applicant is not the manufacturer;
(c) A reference to the version of ADR and standards used for the type examination;
(d) Any requirements resulting from the examination;
(e) The necessary data for identification of the type and variation, as defined by the relevant standard;
(f) The reference to the type examination report(s); and
(g) The maximum period of validity of the type approval. A list of the relevant parts of the technical documentation shall be annexed to the certificate (see 1.8.7.7.1).

Type Approval. Supplier is responsible to Swisscom Mobile for ensuring that its Products meet the relevant Swiss legal regulations and EU conformity requirements. The Handset has to be certified under the GCF (Global Certification Forum) scheme. Swisscom Mobile will inform Supplier on any Swiss legal regulation it is aware of. The CE label must be added to the Products in a reasonably permanent and clearly legible way. The Supplier shall undertake – at its own cost – SAR measurements and shall appropriately publish the results as required by applicable law or regulation. If any of these obligations regarding type approval are not met and BAKOM contacts Swisscom Mobile, Swisscom Mobile shall notify Supplier without delay. Supplier shall handle the issue directly with BAKOM or any other competent authority at Supplier's own cost and risk. Supplier shall hold Swisscom Mobile with regard to such type approval harmless of all costs and damages awarded by a competent authority against Swisscom Mobile and shall give all the necessary support for a solution.

Prior to commencing production of any XM Receivers, Manufacturer will submit to XM for its inspection: (i) three (3) prototypes of each basic model of a receiver that Manufacturer proposes to manufacture (one to XM’s Washington, D.C. facility and two to XM’s innovation center in Florida), so that XM may confirm that such prototype receiver performs in accordance with the XM Format and the Technical Specifications; and (ii) the preliminary design specifications for such receivers, including all circuit diagrams, blueprints (or equivalents thereof), component specifications (if XM requests) and overall specifications of such prototype receiver as it relates to the XM System. If such prototype receiver successfully passes XM’s tests, which will ensure it performs in accordance with the XM Format and the Technical Specifications, it will be qualified as an “XM Receiver” under this Agreement. After a receiver has been qualified as an XM Receiver, only those changes may be made to it that are cosmetic in nature provided that such changes do not affect the XM Marks or the receiver’s function or quality, unless the receiver is resubmitted to XM for testing and XM confirms that this modified receiver continues to qualify as an XM Receiver. All testing will be performed at XM’s then current testing rates. As of the Effective Date, XM’s standard rates are as set forth in Appendix 5, but XM reserves the right to make reasonable changes to its rates without prior notification to Manufacturer.

Type Approval. Under Paragraph 2, Attachment C and Attachment B, the Products are warranted to comply with certain type approval requirements which are referenced in the Specifications. Buyer will be solely responsible for all other type approval and registration requirements, including without limitation such requirements that apply to the Product.
