Unpaid Contributions Sample Clauses

Unpaid Contributions. Neither the Company nor any -------------------- ERISA Affiliate has any liability for unpaid contributions under Section 515 of ERISA with respect to any Pension Plan or Welfare Plan. The Company has paid or will pay by October 31, 1997, all employer matching contributions to its 401(k) Plan through October 31, 1997.
Unpaid Contributions. Should it be established that the company has failed to comply with the requirements of clause 4.6.2 in respect of any employee such company shall be liable to make the appropriate contributions retrospectively to the date the employee was engaged, plus an amount equivalent to the rate of return those contributions would have attracted in the relevant fund had they been paid on the due dates. The making of such contributions satisfies the requirements of clause 4.6.3 excepting that resort to clause 4.6.5 shall not limit any common law action which may be available in relation to death, disablement or any similar cover existing within the terms of a relevant fund.
