Unusual Circumstances Affecting Performance. In the event Grantee cannot meet any or all of the obligations under this Agreement for any reason, Grantee shall immediately notify Grantor of such circumstances in writing. Any modification or extension of the Agreement in respect of such circumstances shall be at the sole discretion of Grantor.
Unusual Circumstances Affecting Performance. In the event that the Grantee cannot meet any or all of the obligations placed upon it by the terms of this Agreement, (1) the Grantee shall immediately notify the Grantor in writing, and (2) the Grantor may, at its sole discretion, make reasonable efforts to assist the Grantee in meeting its obligations under the Agreement. If the Grantee is unable to comply with its obligations under this Agreement for a period no less than thirty (30) days, the Grantee may seek modification in accordance with the procedures set forth in this Agreement, including but not limited to, the extension of the term of this Agreement. Such extension shall be within the sole discretion of the Grantor unless outside of the Grantee’s control.
