UPS System. Subject to Landlord's written consent and approval of all plans and specifications for the location, installation, and all other aspects thereof and compliance with all applicable laws and code in installation, operation, and maintenance, Tenant shall be permitted to install an uninterrupted power source system and emergency stand-by battery system, above ground fuel tank, and generator on the Project in a mutually acceptable location.
UPS System. Tenant shall be permitted to have the exclusive use of one of the existing UPS systems in the Building.
UPS System. Throughout the Term, Tenant shall have the non-exclusive right, at Tenant’s sole cost and expense, to use, maintain and operate the uninterruptible power supply systems (the “Existing UPS System”) in the Buildings (excluding the uninterruptible power supply system located in and serving the small telephone room) as reasonably necessary to furnish the uninterruptible power supply needs for the use of the Premises, subject to all of the applicable terms, covenants and provisions of this Lease. Tenant covenants and agrees that throughout the Term, Tenant shall maintain, replace, repair and operate the Existing UPS System at the sole cost and expense of Tenant and without any charge, cost or expense to Landlord. In connection with the maintenance, replacement, repair and operation of the Existing UPS System, Tenant shall comply with all Applicable Laws and shall procure, maintain and pay for all permits and licenses required therefore, including all renewals thereof. Tenant, at Tenant’s sole cost and expense, shall promptly repair any and all damage to the Buildings and to any part of the Project caused by or resulting from the maintenance, replacement, repair, operation or removal of the Existing UPS System by Tenant pursuant to the provisions of this Section 12.8, except to the extent that such maintenance, repair, replacement, operation or removal resulted in a casualty not caused by Tenant that caused such damage. All costs (if any) incurred by Landlord in connection with the Existing UPS System, including, without limitation, the maintenance and operation thereof, shall be paid by Tenant to Landlord, as Additional Rent, within thirty (30) days after Landlord’s demand therefore. LANDLORD MAKES NO WARRANTIES OF WHATSOEVER NATURE REGARDING THE EXISTING UPS SYSTEM, EXPRESS OR IMPLIED, IT BEING THE INTENTION OF LANDLORD AND TENANT EXPRESSLY TO NEGATE AND EXCLUDE ALL WARRANTIES AS BETWEEN LANDLORD AND TENANT. UPS System. DLR performs daily visual inspections to check for any anomalies on the UPS units and batteries. Inspections are performed twice a year, as per OEM recommendation.
UPS System. During its tenancy, the Existing Tenant installed and utilized two (2) uninterrupted power supply (UPS) systems (collectively, the “UPS Systems” and each, a “UPS System”) in the Building. Tenant may (until the earlier of the expiration or earlier termination of the Lease Term), at Tenant’s sole cost and expense, subject to the provisions of this Lease, use one (1) of two (2) UPS Systems for backup power when standard electricity service to the Building is interrupted; provided however that Tenant’s right to use either UPS System shall be subordinate and secondary to the rights of the “GM Group” (as defined in Section 6.18, below) and the Existing Tenant to use or remove either or both of the UPS Systems, respectively. UPS System. Landlord will make available the existing uninterrupted power supply (“UPS”) system in as-is condition for Tenant’s use. Landlord makes no representation or warranty as to the condition or usability of the UPS system. At Tenant’s request at any time prior to the Commencement Date, Landlord shall remove and dispose of the UPS system.

UPS System. Tenant may maintain an uninterrupted power system in the Premises (including back-up batteries) (collectively, the “UPS System”) at a location reasonably acceptable to Landlord, provided that the installation, maintenance and use thereof complies with Law and such installation is made in accordance with plans and specifications therefor that have been approved by Landlord.
