USE AND OPERATION OF PROPERTY. Seller knows of no facts nor has Seller failed to disclose to Buyer any fact which would prevent Buyer from using, leasing and operating the Property after Closing in the normal manner in which similar properties in the area are used, operated and leased or in the manner in which the Property has been used, leased and operated prior to the Closing Date.
USE AND OPERATION OF PROPERTY. Neither Borrower, nor any agent, employee, or contractor of Borrower, nor any authorized user of the Property may use the Property or allow the Property to be used for the generation, manufacture, storage, disposal, or release of Hazardous Materials. USE AND OPERATION OF PROPERTY. Tenant shall use and occupy the Demised Premises and cause the Demised Premises to be used for general office, assembly and manufacturing, provided however, Tenant shall not use or occupy or allow the Demised Premises or any part thereof to be used or occupied for any unlawful purpose or in material violation of any certificate of occupancy, certificate of compliance, permit or law covering or affecting the use or occupancy of the Demised Premises or any part thereof. Tenant shall not suffer any act to be done or any condition to exist at the Demised Premises or any part thereof which may, in law, constitute a nuisance, public or private, or which may make void or voidable any insurance with respect thereto or which may violate the provisions of this Lease.
USE AND OPERATION OF PROPERTY. The Property shall be used as a laydown area in connection with the construction of a power generation facility on a separate tract of land in the vicinity of the Property, or any other lawful use permitted by applicable zoning and land use restrictions.

Seller has a valid leasehold interest in all of the real property and personal property, tangible and intangible, leased by it, free and clear of any liens, encumbrances or other third party rights. Seller enjoys undisturbed quiet possession of the facility. No claim has been asserted, nor is there any right of claim against Seller, materially adverse to the rights of Seller in such facility, except in connection with the Xxxxxx Case. No material construction, alteration or other leasehold improvement work with respect to any leasehold interest remains to be paid for or performed by Seller.
USE AND OPERATION OF PROPERTY. Except as set forth in Seller's Disclosure Schedule or as specifically qualified by this Agreement or as would not have an adverse effect on the Business, the use and operation of the Property of the Company and its Subsidiaries (whether by them, Tenants or others) are in compliance with all applicable Laws.
