USE OF ANNUAL LEAVE WHEN PERMANENTLY INCAPACITATED. Annual leave shall not be used to continue the pay of any employee after it has been determined by the County's Occupational Health Physician that such employee is permanently incapacitated for a return to County employment and is eligible for retirement. Annual leave credits may be utilized by such employee after such determination has been made in conformance with Section 4850 of the California Labor Code and/or appropriate action has been taken by the Ventura County Retirement Board.
