Use of Lockbox. To designate a lockbox collection agent for collections of amounts due Landlord. In that case, the date of payment of Rent or other sums shall be the date of the agent's receipt of such payment or the date of actual collection if payment is made in the form of a negotiable instrument thereafter dishonored upon presentment. However, Landlord may reject any payment for all purposes as of the date of receipt or actual collection by mailing to Tenant within 21 days after such receipt or collection a check equal to the amount sent by Tenant.

In this regard, Owner has been informed that by using a lockbox system the Property may be more readily shown to prospective Buyers, but the personal property of Owner may, therefore, be more susceptible to theft or damage. Owner agrees that the lockbox, if utilized, will be for the benefit of Owner and releases Century 21 HomeStar, its members, employees, and agents from any and all liability and damages in connection with any loss that may occur. Century 21 Homestar advises and requests Owner safeguard or remove any valuables now located on the Property and verify the existence of, or obtain, personal property insurance. If a tenant is occupying the Property, Owner shall notify the tenant in writing about the use of a lockbox.

Use of Lockbox. Company will instruct its customers to limit use of the Lockbox to the receipt of Checks (checks, drafts and money orders) and, if applicable, Charges (credit card payments) only. Cash remittances or other items of value cannot be sent to Company’s Lockbox. Company must instruct Company’s remitters not to send such items to the Remittance Address. If Bank receives any cash or other such items, Bank will use reasonable efforts to (i) Deposit any cash remittances in Company’s designated Account; and (ii) Forward to Company any other items of value received at the Remittance Address. Bank is not, however, liable to any person for any cash remittances or other items of value sent to Company’s Remittance Address which may be lost, stolen or misplaced. With respect to any sundry correspondence or other related documents other than Lockbox documents sent to Company’s Lockbox, Bank will make a good faith effort to image or return such documents to Company per Company’s instructions and Bank shall not be responsible for lost, stolen or misplaced documents. Bank will not read, inspect or otherwise process such correspondence or documents.
Use of Lockbox. (Check one) Owner ( authorizes) ( does NOT authorize) utilization of a lockbox system. In this regard, Owner has been informed that through the use of a lockbox system the property may be more readily shown to prospective Tenants, but personal property of Owner may, therefore, be susceptible to theft or damage. Owner agrees that the lockbox, if utilized, will be for the benefit of the Owner and releases Brokerage and those working by or through Brokerage, and Brokerage(s) local Board(s) Association(s) of Realtors from all liability and responsibility in connection with any loss that may occur. Brokerage advises and requests Owner to safeguard or remove any valuables now located on the property and verify the existence of, or obtain, proper personal property insurance. Should a tenant be in the property, Owner should notify the tenant in writing of the use of a lockbox.

In that case, the date of payment of Rent or, as to Landlord only, other sums shall be the date of the agent's receipt of such payment or the date of actual collection if payment is made in the form of a negotiable instrument thereafter dishonored upon presentment. However, Sublandlord may reject any payment for all purposes as of the date of receipt or actual collection by mailing to Subtenant within 21 days after such receipt or collection a check equal to the amount sent by Subtenant.

In that case, the date of payment of Rent or other sums shall be the date of the agent’s receipt of such payment or the date of actual collection if payment is made in the form of a negotiable instrument thereafter dishonored upon presentation. However, Landlord may reject any payment for all purposes as of the date of receipt or actual collection by mailing to Tenant within a reasonable time after such receipt or collection a check equal to the amount sent by Tenant provided that Tenant is then in “Default” under the terms of this Lease (as defined in Section 13).

In that case, the date of payment of Rent or other sums shall be the date of the agent’s receipt of such payment or the date of actual collection if payment is made in the form of a negotiable instrument thereafter dishonored upon presentment. However, if Tenant is in default under this Lease, Landlord may reject any payment for all purposes as of the date of receipt or actual collection by mailing to Tenant, within twenty-one (21) days after such receipt or collection, a check equal to the amount sent by Tenant.

However, Landlord may reject any payment for all purposes as of the date of receipt or actual collection by mailing to Tenant within 21 days after such receipt or collection the amount sent by Tenant; provided, however, that the foregoing shall not apply to any payments timely made in full performance of Tenant's obligations under this Lease inclusive of any full payments made within any applicable cure period. It is the intent of this provision to prevent waiver of claims for payment as the result of any partial payments or of any full payments made after any applicable cure period.
