Use of Premises and Removal of Debris. 37.1 The Contractor expressly undertakes at his own expense:
A. to take every precaution against injuries to persons or damage to property;
B. to store his apparatus, materials, supplies and equipment in such orderly fashion at the site of the work as will not unduly interfere with the progress of his work or the work of any other contractors;
C. to place upon the work or any part thereof only such loads as are consistent with the safety of the portion of the work;
D. to clean up frequently all refuse, rubbish, scrap materials, and debris caused by his operations, to the end that at all times the site of the work shall present a neat, orderly and workmanlike appearance;
E. before final payment to remove all surplus material, false-work, temporary structures, including foundations thereof, plant of any description and debris of every nature resulting from his operations, and to put the site in a neat, orderly condition.
F. to effect all cutting, fitting or patching of his work required to make the same to conform to the plans and specifications and, except with the consent of the Architect/Engineer, not to cut or otherwise alter the work of any other Contractor.
Use of Premises and Removal of Debris a. The CONSTRUCTION MANAGER on this Work expressly agrees to undertake the following:
1.) every precaution against injuries to persons or damage to property;
2.) storage of his apparatus, materials, supplies, and equipment in such orderly fashion at the site of the Work as will not unduly interfere with the progress of his work or the work of any other Contractor working on the site;
3.) to place upon the Work or any part thereof only such loads as are consistent with the safety of the portion of the Work;
4.) that before final payment he will remove all surplus materials, false work, temporary structures, including foundations thereof, plant of any description, and debris of every nature resulting from his operations, and to leave the Work in a neat, orderly condition suitable for use and occupancy;
5.) at all times during the progress of the Work keep the building and the site free from accumulation of debris resulting from the Work. If the accumulation of waste matter and rubbish interfere with the Work of others or present a fire hazard, it shall be removed immediately; and
6.) to confine his apparatus, materials, and operations of his workmen to limits prescribed by law or by contract limit lines except as the latter may be extended with the approval of the OWNER.
b. Burning of rubbish or waste material will not be permitted.
c. Removal of all waste and rubbish resulting from the Work shall be through chutes or lowered by hoists in receptacles.

The Vendor shall (1) perform the contract in such a manner as not to interrupt or interfere with the operation of any other activity or vendors on the premises; (2) store apparatus, materials, supplies, and equipment in such orderly fashion at the site as will not unduly interfere with spectator traffic or adjacent activities; (3) clean up frequently all refuse, rubbish, and debris caused by its operations such that at all times the work space shall present a neat, orderly, and professional appearance and (4) at the end of the event, remove all trash, refuse, equipment and other items off the premises by 7 p.m. on the day of the performance. After that time, the County may claim ownership of any items left on the premises.

c. Place upon the work or any part thereof only such loads as are consistent with the safety of that portion of the work.
2. The Contractor expressly undertakes, either directly or through his subcontractor(s), to affect all cutting, filling, or patching of his work required to make the same conform to the drawings and specifications, and, except with the consent of the University, not to cut or otherwise alter the work of any other Contractor. The Contractor shall not damage or endanger any portion of the work or premises, including existing improvements, unless called for by the contract.
3. The Contractor expressly undertakes, either directly or through his subcontractor(s), to clean up frequently all refuse, rubbish, scrap materials, and debris caused by his operations, to the end that at all times the site of the work shall present a neat, orderly, and workmanlike appearance. No such refuse, rubbish, scrap material, and debris shall be left within the completed work nor buried on the building site, but shall be removed from the site and properly disposed of in a licensed landfill or otherwise as required by law.
4. The Contractor expressly undertakes, either directly or through his subcontractor(s), before final payment, to remove all surplus material, false work, temporary structures, including foundations thereof, plants of any description and debris of every nature resulting from his operations and to put the site in a neat, orderly condition; to thoroughly clean and leave reasonably dust free all finished surfaces including all equipment, piping, etc., on the interior of all buildings included in the contract; and to thoroughly clean all glass installed under the contract including the removal of all paint and mortar splatters and other defacements. If a Contractor fails to clean up at the completion of the work, the University may do so and charge for costs thereof to the Contractor.

c. Strictly ensure and be solely responsible for the enforcement requirements that solid waste originating in whole or in part from outside the City be attributed to the responsible city, knowingly or otherwise.
d. Franchisee is required to conduct business operations at 10 Xxxx Ranch Road. The Franchisee shall pay appropriate expenses associated with the rental of this property for the term of this Agreement.

After that time, the County may claim ownership of any items left on the premises.
