Variation of Fees. (a) Subject to clauses 6.1(b) and 6.4, Powernet may amend Fees at any time with effect after 30 days in respect of Services not then delivered or performed, by giving notice to the Client or by Powernet changing its Standard Prices published on the Website.
(b) Powernet may not increase Fees applying in respect of the Minimum Term or fixed price contracts until the Minimum Term or period of the fixed price contract has expired, except in accordance with clause 6.1(c).
(c) Powernet may pass on price increases during the Minimum Term or a fixed price contract:
(i) which third party suppliers impose on Powernet; or
(ii) which are imposed on Powernet by law such as an increase in GST; but in either of those events Powernet will provide the Client with notice at least 30 days prior to the date on which the variation is intended to take effect.
Variation of Fees. The Fees may be varied by agreement in writing between the Company and the Contractor.
Variation of Fees. We may vary the Fees by publishing the variation on xxxxxxxxx.xxx or by otherwise giving CLEARINGHOUSE 90 days’ notice of the variation prior to the effective date of the variation, provided that the Fees shall not be varied during the Initial Term.
Variation of Fees. 4.1. We may offer you updated Fees where you request any changes to the specifics of the Products to be supplied, such as a change to the nominated place for delivery; or a change in the Equipment to be rented.
4.2. We may adjust the Fees provided we give you at least 30 days’ notice. The new Fees will then be effective for any order placed after the 30-day notice period has passed.
4.3. We may adjust the Fees at any time to: (a) reflect changes in our costs of supply, including (without limitation) third party supplier costs; fuel costs (including the fuel levy); or (b) a Change in Law; which increases our costs in providing the Products and/or Services and/or Equipment.
4.4. If we propose to adjust the Fees charged to you, we will notify you as soon as possible. If you do not want to accept the Fee adjustment, you may cancel the order on giving us at least 48 hours’ notice, or, in the case of Custom Mixes, at least 10 days’ notice.
Variation of Fees. 5.1 Except as expressly permitted to increase the Initial Fee and/or Annual Fee under this Agreement, the Distributor may (subject to any provision to the contrary in any Schedule) vary its Fees not more than once in every successive period of 12 months during the term of the applicable Agreement by giving not less than 30 days’ notice to the Customer.
5.2 Subject to any provision to the contrary in any Schedule, any of the Fees may be increased by the Distributor with prior notice to the Customer, but by no more than the greater of:
5.2.1 whichever is the greater of three percent per annum or the percentage increase in the September CPI as published by the Office of National Statistics in document Table 36 over the September CPI indices of the preceding year. Updated information regarding Fees shall be posted on xxx.x0x.xx.xx and shall be available in written form upon request.
Variation of Fees. After the Relevant Date, PPM may vary its hourly rates and other Fees for the Services by giving the Customer not less than 30 days' written notice.
Variation of Fees. Alncom may alter the Fees from time to time by notice in writing to the Customer within a reasonable period in advance of the effective date of such change.
Variation of Fees. Annexure 1 reflects the current fee structure of Qualitrack based on its current costs. Qualitrack reserves the right to review and amend its fees as and when required.
Variation of Fees. EATS is entitled to vary the rates during the term of this agreement with written notice to the Client prior to the change being implemented.
