Variation Order. Whether or not the Contract Administrator has issued a Variation Price Request under clause 11.1, at any time prior to the Date of Completion (but without limiting clauses 5.3 and 9.6), the Contract Administrator may instruct the Contractor to carry out a Variation by a written document titled "Variation Order" in which the Contract Administrator will state one of the following: the proposed adjustment to the Contract Price set out in the Contractor's notice under clause 11.1 (if any) is agreed and the Contract Price will be adjusted accordingly; any adjustment to the Contract Price will be determined under clauses 11.3(b) and 11.3(c); or the Variation is to be carried out as daywork and any adjustment to the Contract Price will be determined under clause 11.3(d). No Variation will invalidate the Contract irrespective of the nature, extent or value of the work the subject of the Variation.
Variation Order. Whether or not the Contractor's Representative has issued a Variation Price Request under clause 10.1, at any time the Contractor's Representative may at any time prior to completion of the Services instruct the Consultant to carry out a Variation by a written document titled "Variation Order", in which the Contractor's Representative will state one of the following: the proposed adjustment to the Fee set out in the Consultant's notice under clause 10.1 (if any) is agreed and the Fee will be adjusted accordingly; or any adjustment to the Fee will be determined under clauses 10.3(b) and 10.3(c). No Variation will invalidate the Subcontract irrespective of the nature, extent or value of the work the subject of the Variation.

Whether or not the Contractor’s Representative has issued a Variation Price Request under clause 11.1, at any time prior to the Date of Completion (but without limiting clauses 5.3 and 9.6), the Contractor’s Representative may instruct the Subcontractor to carry out a Variation by a written document titled “Variation Order” in which the Contractor’s Representative will state one of the following: the proposed adjustment to the Subcontract Price set out in the Subcontractor’s notice under clause 11.1 (if any) is agreed and the Subcontract Price will be adjusted accordingly; any adjustment to the Subcontract Price will be determined under clauses 11.3(b) and 11.3(c); or the Variation is to be carried out as daywork and any adjustment to the Subcontract Price will be determined under clause 11.3(d). No Variation will invalidate the Subcontract irrespective of the nature, extent or value of the work the subject of the Variation.
Variation Order. Whether or not the Contract Administrator has issued a "Variation Price Request" under clause 10.1, the Contract Administrator may, at any time prior to completion of the Services, instruct the Consultant to carry out a Variation by a written document titled "Variation Order", in which the Contract Administrator will state one of the following: the proposed adjustment to the Fee set out in the Consultant's notice under clause 10.1 (if any) is agreed and the Fee will be adjusted accordingly; or any adjustment to the Fee will be determined under clauses 10.3(b) and 10.3(c). No Variation will invalidate the Contract irrespective of the nature, extent or value of the work the subject of the Variation.
Variation Order. Whether or not the Contractor's Representative has issued a Variation Price Request under clause 10.1, the Contractor's Representative may at any time prior to the date of Completion (but without limiting clause 8.5) direct the Subcontractor to carry out a Variation by a written document titled “Variation Order”.
Variation Order. (a) Subject to the Principal first conducting a review in accordance with the Review Procedure, the Principal may direct the Operator to carry out a Variation by issuing a written document titled "Variation Order" setting out a proposed Variation to:
(i) the Services Specification;
(ii) the Payments Schedule;
(iii) the Verification Methodology; and/or
(iv) any other applicable provision of this Agreement, as well as a price for that Variation as determined in accordance with clause 5.2(b), both of which will take effect from the date specified in the Variation Order (a Variation Order).
(b) The Principal must price the Variation using the following order of precedence:
(i) prior agreement between the Principal and the Operator;
(ii) applicable rates or fees in this Agreement; and
(iii) reasonable rates or fees (as determined by the Principal in its reasonable opinion), to address any direct costs reasonably incurred (or to be incurred), or savings made (or to be made) by the Operator as a consequence of the proposed Variation.
(c) Subject to clauses 5.2(d) to 5.2(f), both parties must comply with any Variation Order issued in accordance with this Agreement and any Variation will be binding on the parties as if it was included in this Agreement, including if the Operator does not issue a Dissatisfaction Notice in accordance with clause 5.2(d).
(d) If the Operator does not agree to a Variation directed under a Variation Order, it may issue a notice setting out its reasons to the Principal (Dissatisfaction Notice) within 10 Business Days of issue of the Variation Order. If the Operator does not issue a Dissatisfaction Notice in accordance with this clause 5.2(d), the parties will be bound to comply with the Variation Order and clause 5.2
Variation Order. Whether or not the Contract Administrator has issued a "Variation Price Request" under clause 10.1, the Contract Administrator may direct the Contractor to carry out a Variation by a written document titled "Variation Order", in which the Contract Administrator will state one of the following: the proposed adjustment to the Contract Price as set out in the Contractor's notice under clause 10.1 (if any) is agreed and the Contract Price will be adjusted accordingly; or any adjustment to the Contract Price will be determined under clauses 10.3(a) and 10.3(b). No Variation will invalidate the Contract irrespective of the nature, extent or value of the services the subject of the Variation. Subject to clauses 8.4, 8.5, 10.4 and 12.3, the Contract Price will be adjusted for the value of all Variations carried out by the Contractor by: if there is a Table of Variation Rates and Prices, an amount determined by using any rates or prices in this which may be applicable to the Variation; or a reasonable amount to be agreed between the parties or, in default of such agreement, determined by the Contract Administrator. In either case the value of the Variation must include any extra reasonable costs which will be incurred by the Contractor as a direct result of the Variation delaying the Contractor achieving Completion by the Date for Completion.
Variation Order. Whether or not the PDS Contractor has issued a Variation Price Request under clause 10.1, the PDS Contractor may at any time direct the Contractor to carry out a Variation by a written document titled "Variation Order".
Variation Order. (a) Within a reasonable period after receipt of a VARIATION ASSESSMENT, COMPANY will: Section IIIA – Special Terms and Conditions
(i) accept the VARIATION ASSESSMENT by issuing a VARIATION ORDER in accordance with the VARIATION ASSESSMENT;
(ii) reject the VARIATION ASSESSMENT and confirm to CONTRACTOR that it does not wish to pursue the proposed VARIATION;
(iii) request that CONTRACTOR amend and re-issue the VARIATION ASSESSMENT for reasons stated by COMPANY; or
(iv) reject the VARIATION ASSESSMENT for reasons stated by COMPANY and issue a VARIATION ORDER in which COMPANY determines the consequences of the VARIATION through its own reasonable determination.
(b) If COMPANY issues a VARIATION ORDER for reasons of emergency, safety, or other reasonable necessity as provided above, COMPANY will make a reasonable determination of the consequences of the VARIATION, and set out the conclusions in the VARIATION ORDER.
