Vegetation; Structures. Lessor agrees that it shall not permit any new structure, vegetation, or activity on the Site or the System Premises to penetrate the airspace within its control in any manner that would cast a shadow on the System solar panels, other than air handling, HVAC and mechanical units and other building fixtures and improvements that are currently on the roofs of the buildings at the Site, or any repairs of or replacements to such fixtures and improvements that do not increase the size or duration of any shadow cast on the System solar panels by the fixtures and improvements that are present on the Site as of the Effective Date.

Vegetation; Structures. Northern Water shall not permit any new structure or activity, or plant any new vegetation on Tract B or the System Premises to penetrate the airspace within its control in any manner that would cast a shadow on the System, other than air handling, HVAC and mechanical units and other building fixtures and improvements that are currently on the roofs of the buildings on Tract B, or any repairs of or replacements to such fixtures and improvements that do not materially increase the size or duration of any shadow cast on the System by the fixtures and improvements that are present on the Site as of the Effective Date., except in event of emergency or unforeseen need for use of the System Premises as described in Section .2.4.

  • Classification Structure All employees working under this Agreement shall be classified according to the skill based classification structure set out in Appendix A.
