Use of the System. From the commencement date, the Provider shall use the System as required to provide the services to the Authority in accordance with this agreement.
Use of the System. 4.1 User agrees to use the Programs only and solely in the Approved Technical Environment and in accordance with Ex Libris’ then applicable operating instructions. 4.2 User may not change or alter the Program nor merge it with other computer programs without the prior written consent of Ex Libris.
Use of the System. (a) Your use of the System shall be subject to all applicable laws, statutes, rules and regulations (whether domestic or foreign), orders of competent governmental, legal or regulatory authorities, agreements with or between such authorities and the interpretations of any such authority (“Applicable Law”). You are responsible for ensuring that You may lawfully access and use the System and the services and content offered on or through it. You agree that Citibank may assume, and You represent, that any Instruction made by a person using Your Security Procedures
(a) is from You; (b) originates from the location (including country, state, province or other jurisdiction) that has been associated with You on our records; and (c) is authorized by Your Firm. You represent and warrant on a continuing basis as long as You are authorized to access and use the System that:
(i) You shall use the System only for Your own business purposes and only in conformity with this Agreement, any relevant System manual, and Applicable Law;
(ii) You will not use the System or any feature of the System to post or transmit inappropriate information, including without limitation any information that may be deemed obscene, libellous, harassing, fraudulent, or slanderous, or post or transmit any information, software, or other material that is an invasion of privacy or publicity rights, or which is in breach of any copyright, trademark, service xxxx, or other proprietary right;
(iii) You have in place security systems and procedures reasonably designed and applied to prevent unauthorized use or misuse of the System and will ensure that the Authorized Users and all other employees comply with all such security measures;
(iv) You have obtained or will obtain and will maintain all notifications, authorizations and approvals and will provide all such information to its regulators as is required under Applicable Law for You to use the System and enter into any Transactions through the System, and perform Your obligations under those Transactions and this Agreement;
(v) You will be fully responsible for any use or misuse of the System by You or by any other individual or entity which is able to access the System as a result of Your failure to observe and protect the Security Procedures as required by this Agreement.
(b) Where You are acting as an Agent You further represent and warrant that:

Use of the System. 3.1 Customer shall only use, access, and operate the System, in compliance with all applicable Laws. Customer may only use or access the System when it is safe to do so. Access to or use of the System is at Customer’s sole risk. Customer is solely responsibility to exercise its own discretion, and observe all safety measures required by Law, as to how and when to access or use the System and the Services.
3.2 The System and Services are NOT FOR EMERGENCIES or EMERGENCY SITUATIONS, including vehicle or medical emergencies. CUSTOMER ACKNOWLEDGES AND AGREES THAT THE SERVICE IS LIMITED SOLELY TO RELAYING INFORMATION COLLECTED BY THE SYSTEM TO CUSTOMER, AND THAT COMPANY HAS NO DUTY OR OBLIGATION TO ACTIVELY MONITOR ANALYZE, NOTIFY, RESPOND TO, OR FOLLOW-UP ON ANY DATA RELAYED FROM TIME TO TIME TO CUSTOMER. Customer shall ensure that Pace Device users are advised not to disregard or delay seeking emergency help based on anything that does or does not appear on the System or Services.
3.3 Customer may be required to create an account to use the System and the Services. Customer shall protect the security of the System at all times by ensuring that access and login credentials are maintained confidential and secure. Customer agrees to prohibit any third party from using Xxxxxxxx’s account credentials and agree to immediately notify Company of any actual or suspected unauthorized use of Customer’s account credentials or other security concerns of which Customer becomes aware. As part of the Services, for the purpose of protecting the security of Customer’s account, Customer’s rights, and the security of the Pace Device and the System, Customer agrees that Company may: (i) monitor the System in Customer’s Pace Device and vehicles having Pace Devices, and the information within them; and

Use of the System. 8.1. Use of WinStar Fibers. WinStar may use the WinStar Fibers for any lawful purpose.
Use of the System. Customer and Users will not: • misuse or abuse any EIS, its subcontractor, or third party property (including, without limitation, software, equipment, networks, and network devices); • make any unauthorized use of or interfere with any property of EIS, its subcontractors, or any EIS or SAS customer; • engage in any activity in violation of the law or that aids or assists any criminal activity in connection with the access or use of the System; • impair or disrupt any connections to the System; • interfere or attempt to interfere in any manner with the functionality or proper working of the System; • remove, obscure or alter any notice of ownership or any other intellectual or proprietary right appearing on or contained within the System; • use any open source software in connection with the System in any manner that requires, pursuant to the license applicable to such open source software, that any part of the System be (a) disclosed or distributed in source code form; (b) made available free of charge to recipients; or (c) modifiable without restriction by recipients; • reverse engineer, disassemble or decompile any part of the System; or • upload any software or application(s) to the System except as expressly allowed subject to Section 8.4 (Customer Materials) of this Attachment A.
Use of the System. During the Term, Customer may access and use the System pursuant to the terms of any outstanding Order, including such features and functions as the Order requires.
Use of the System. Franchisee acknowledges that Franchisor and its Affiliates will allow other Franchisor Lodging Facilities to use various parts of the System and may allow other lodging facilities to use various parts of the System under affiliation or marketing agreements.
Use of the System. ECC hereby grants Agency permission to use the System, subject to the following:
a. Agency shall comply with the rules, regulations, policies and standards established by the ECC (except in the event of conflict with the terms and conditions of this Agreement, which shall control).
b. Agency shall comply with all laws, rules and regulations relating to use of the System, including but not limited to FCC regulations. Agency shall comply with any and all mandates issued by the FCC and authorized regulatory agencies. If, subsequent to this Agreement, technical or other changes are mandated by the FCC, Agency must timely comply with the mandate(s). The ECC will not be responsible for any costs, damages or losses incurred due to the regulatory mandate(s).
c. Agency shall comply within 1 year of receipt of notice from the ECC with any voluntary upgrades or changes to the System by the ECC, including change in vendor. The ECC shall have the sole discretion to upgrade or change the System. The ECC will not be responsible for any expenditure, losses, or other claims caused by or attributed to such voluntary upgrades or changes to the System.
d. Agency is prohibited from selling, assigning or transferring any right of use to the System, in whole or in part, to any other person or entity.
