Common use of Virtual Collocation Clause in Contracts

Virtual Collocation. (a) If Requesting Carrier requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting Carrier's request, Ameritech shall include in its notice to Requesting Carrier described in Section 12.12.1 (i) the space to be provided and (ii) whether Ameritech can deliver the space to Requesting Carrier by the date set forth in Section 12.12.3(c). (b) Ameritech and Requesting Carrier will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier for Virtual Collocation on the earlier of (i) ten (10) Business Days after Ameritech's verification of the Virtual Collocation space to be provided to Requesting Carrier and (ii) fourteen (14) days after Ameritech's receipt of Requesting Carrier's request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expenses. (c) Ameritech shall deliver to Requesting Carrier the requested space on or before the later of (i) twelve (12) weeks from Ameritech's receipt of Requesting Carrier's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and Ameritech notified Requesting Carrier of this fact within ten (10) Business Days after the initial walkthrough. (d) Virtual Collocation space ordered by Requesting Carrier will be made available to Requesting Carrier by Ameritech, as more fully described in Section 3 of Schedule 12.12. (e) After completion of construction, Requesting Carrier and Ameritech will complete an acceptance walkthrough of all Collocation space requested from Ameritech. Exceptions that are noted during this acceptance walkthrough shall be corrected by Ameritech within thirty (30) days after the walkthrough. Ameritech shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at Ameritech's expense, subject to any change orders requested by Requesting Carrier. (f) Ameritech shall install Cross-Connects when cross-connecting for through connect purposes as directed by Requesting Carrier at the rates provided at Item VII of the Pricing Schedule.

Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with (i) documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expensesexpenses and (ii) a parallel installation sequence. (c) Ameritech shall deliver to Requesting Carrier the requested space on or before the later of (i) twelve (12) weeks from Ameritech's receipt of Requesting Carrier's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and Ameritech notified Requesting Carrier of this fact within ten (10) Business Days after the initial walkthroughfrom Ameritech's receipt of Requesting Carrier's request. (d) Virtual Collocation space ordered by Requesting Carrier will be made available to Requesting Carrier by Ameritech, as more fully described in Section 3 of Schedule 12.12. (e) Ameritech shall provide positive confirmation to Requesting Carrier when construction of Requesting Carrier-collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of construction, Requesting Carrier and Ameritech will complete an acceptance walkthrough of all Collocation Collocated space requested from Ameritech. Exceptions that are noted during this acceptance walkthrough shall be corrected by Ameritech within thirty (30) days after the walkthrough. Ameritech shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at Ameritech's expense, subject to any change charge orders requested by Requesting Carrier. (fg) Ameritech shall install Crosscross-Connects connects when cross-connecting for through thru connect purposes as directed by Requesting Carrier at the rates provided at Item VII of the Pricing Schedule.

Virtual Collocation. (a) If Requesting Carrier Intermedia requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier Intermedia elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting CarrierIntermedia's request, Ameritech CBT shall include in its notice to Requesting Carrier Intermedia described in Section 12.12.1 12.12.1, (i) the space to be provided and (ii) whether Ameritech CBT can deliver the space to Requesting Carrier Intermedia by the date set forth in Section 12.12.3(c). (b) Ameritech CBT and Requesting Carrier Intermedia will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier Intermedia for Virtual Collocation on the date that is the earlier of (i) ten (10) Business Days after Ameritech's CBT’s verification of the Virtual Collocation space to be provided to Requesting Carrier Intermedia and (ii) fourteen (14) calendar days after Ameritech's CBT’s receipt of Requesting Carrier's Intermedia’s request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expenses. (c) Ameritech CBT shall deliver to Requesting Carrier Intermedia the requested space on or before the later of (i) twelve seventy-five (1275) weeks days from AmeritechCBT's receipt of Requesting CarrierIntermedia's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech CBT to deliver to Requesting Carrier Intermedia such space within twelve seventy-five (1275) weeks days (such date of delivery referred to as the “Delivery Date”) and Ameritech CBT notified Requesting Carrier Intermedia of this fact within ten (10) Business Days after the initial walkthroughfrom CBT's receipt of Intermedia's request. (d) Virtual Collocation space ordered requested by Requesting Carrier Intermedia will be made available to Requesting Carrier Intermedia by AmeritechCBT, as more fully described in Section 3 of Schedule 12.12. (e) CBT shall provide positive confirmation to Intermedia when construction of Intermedia Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of constructionconstruction and on or before the Delivery Date, Requesting Carrier Intermedia and Ameritech CBT will complete an acceptance walkthrough of all Collocation Collocated space requested from AmeritechCBT. (b) Ameritech and Requesting Carrier Frontier will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier Frontier for Virtual Collocation on the earlier of (i) ten (10) Business Days after Ameritech's verification of the Virtual Collocation space to be provided to Requesting Carrier Frontier and (ii) fourteen (14) days after Ameritech's receipt of Requesting CarrierFrontier's request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier Frontier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier Frontier that will be billed as extraordinary expenses. (c) Ameritech shall deliver to Requesting Carrier Frontier the requested space on or before the later of (i) twelve (12) weeks from Ameritech's receipt of Requesting CarrierFrontier's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier Frontier such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and Ameritech notified Requesting Carrier Frontier of this fact within ten (10) Business Days after the initial walkthrough.. 861229.2 102208 1516C 96252093 (d) Virtual Collocation space ordered by Requesting Carrier Frontier will be made available to Requesting Carrier Frontier by Ameritech, as more fully described in Section 3 of Schedule 12.12. The correction of these exceptions from the Intermedia’s original request for Collocation as modified by any changes requested by Intermedia shall be at Ameritech's expense, CBT’s expense and shall be subject to any change orders requested an additional walkthrough and acceptance by Requesting CarrierIntermedia. (f) Ameritech shall install Cross-Connects when cross-connecting for through connect purposes as directed by Requesting Carrier at the rates provided at Item VII of the Pricing Schedule.

(a) If Requesting Carrier TCG requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier TCG elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting Carrier's TCG’s request, Ameritech shall include in its notice to Requesting Carrier TCG described in Section 12.12.1 12.12.1, (i) the space to be provided and (ii) whether Ameritech can deliver the space to Requesting Carrier TCG by the date set forth in Section 12.12.3(c). (b) Ameritech and Requesting Carrier TCG will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier TCG for Virtual Collocation on the earlier of (i) ten (10) Business Days after of Ameritech's ’s verification of the Virtual Collocation space to be provided to Requesting Carrier TCG and (ii) fourteen ten (1410) days Business Days after Ameritech's ’s receipt of Requesting Carrier's request for Virtual Vii Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier TCG with (i) documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier TCG that will be billed as extraordinary expenses. expenses and (cii) a parallel installation sequence. Ameritech shall deliver to Requesting Carrier TCG the requested space on or before the later of (i) twelve (12) weeks from Ameritech's ’s receipt of Requesting Carrier's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier TCG such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and Ameritech notified Requesting Carrier TCG of this fact within ten (10) Business Days after from the initial walkthrough. (d) . Virtual Collocation space ordered by Requesting Carrier TCG will be made available to Requesting Carrier TCG by Ameritech, as more fully described in Section 3 of Schedule 12.12. . Ameritech shall provide positive to TCG when construction of space is percent (e50%) completed. confiiation shall also include confiition of the scheduled completion date and the Delivery Date. After completion of construction, Requesting Carrier TCG and Ameritech will complete an acceptance walkthrough of all Collocation Collocated space requested from Ameritech. Ameritech shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at Ameritech's ’s expense, subject to any change orders requested by Requesting Carrier. (f) TCG. Ameritech shall install Crosscross-Connects connects when cross-connecting for through connect purposes as directed by Requesting Carrier TCG at the rates provided at Item VII of the Pricing Schedule.

(a) If Requesting Carrier TELIGENT requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier TELIGENT elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting CarrierTELIGENT's request, Ameritech CBT shall include in its notice to Requesting Carrier TELIGENT described in Section 12.12.1 12.13.1, (i) the space to be provided and (ii) whether Ameritech CBT can deliver the space to Requesting Carrier TELIGENT by the date set forth in Section 12.12.3(c12.13.3(c). (b) Ameritech CBT and Requesting Carrier TELIGENT will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier TELIGENT for Virtual Collocation on the date that is the earlier of (i) ten (10) Business Days after Ameritech's CBT=s verification of the Virtual Collocation space to be provided to Requesting Carrier TELIGENT and (ii) fourteen (14) calendar days after Ameritech's CBT=s receipt of Requesting Carrier's TELIGENT=s request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expenses. (c) Ameritech CBT shall deliver to Requesting Carrier TELIGENT the requested space on or before the later of (i) twelve seventy-five (1275) weeks days from AmeritechCBT's receipt of Requesting CarrierTELIGENT's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech CBT to deliver to Requesting Carrier TELIGENT such space within twelve seventy-five (1275) weeks days (such date of delivery referred to as the “Delivery Date”) and Ameritech CBT notified Requesting Carrier TELIGENT of this fact within ten (10) Business Days after the initial walkthroughfrom CBT's receipt of TELIGENT's request. (d) Virtual Collocation space ordered requested by Requesting Carrier TELIGENT will be made available to Requesting Carrier TELIGENT by AmeritechCBT, as more fully described in Section 3 of Schedule 12.1212.13. (e) CBT shall provide positive confirmation to TELIGENT when construction of TELIGENT Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Team will establish a process for determining when construction is fifty percent (50%) complete. (a) If Requesting Carrier Urban Media requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier Urban Media elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting CarrierUrban Media's request, Ameritech shall include in its notice to Requesting Carrier Urban Media described in Section 12.12.1 12.12.1, (i) the space to be provided and (ii) whether Ameritech can deliver the space to Requesting Carrier Urban Media by the date set forth in Section 12.12.3(c). (b) Ameritech and Requesting Carrier Urban Media will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier Urban Media for Virtual Collocation on the earlier of (i) ten (10) Business Days after of Ameritech's verification of the Virtual Collocation space to be provided to Requesting Carrier Urban Media and (ii) fourteen (14) calendar days after AmeritechXxxxxxxxx's receipt of Requesting CarrierUrban Media's request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier Urban Media with (i) documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier Urban Media that will be billed as extraordinary expensesexpenses and (ii) a parallel installation sequence. (c) Ameritech shall deliver to Requesting Carrier Urban Media the requested space on or before the later of (i) twelve (12) weeks from Ameritech's receipt of Requesting CarrierUrban Media's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier Urban Media such space within twelve (12) weeks (such date of delivery referred to as the (“Delivery Date”) and Ameritech notified Requesting Carrier Urban Media of this fact within ten (10) Business Days after the initial walkthroughfrom Ameritech's receipt of Urban Media's request. (d) Virtual Collocation space ordered by Requesting Carrier Urban Media will be made available to Requesting Carrier Urban Media by Ameritech, as more fully described in Section 3 of Schedule 12.12. (e) Ameritech shall provide positive confirmation to Urban Media when construction of Urban Media-collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of construction, Requesting Carrier Urban Media and Ameritech will complete an acceptance walkthrough of all Collocation Collocated space requested from Ameritech. Exceptions that are noted during this acceptance walkthrough shall be corrected by Ameritech within thirty (30) days after the walkthrough. Ameritech shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at Ameritech's expense, subject to any change charge orders requested by Requesting CarrierUrban Media. (fg) Ameritech shall install Crosscross-Connects connects when cross-connecting for through thru connect purposes as directed by Requesting Carrier Urban Media at the rates provided at Item VII of the Pricing Schedule.

Virtual Collocation. (a) If Requesting Carrier Frontier requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier Frontier elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting CarrierFrontier's request, Ameritech shall include in its notice to Requesting Carrier Frontier described in Section 12.12.1 12.12.1 (i) the space to be provided and (ii) whether Ameritech can deliver the space to Requesting Carrier Frontier by the date set forth in Section 12.12.3(c).. 6275755.2 101408 910C 96252093 (b) Ameritech and Requesting Carrier Frontier will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier Frontier for Virtual Collocation on the earlier of (i) ten (10) Business Days after Ameritech's verification of the Virtual Collocation space to be provided to Requesting Carrier Frontier and (ii) fourteen (14) days after Ameritech's receipt of Requesting CarrierFrontier's request for Virtual Collocation. (d) Virtual Collocation space ordered by Requesting Carrier Frontier will be made available to Requesting Carrier Frontier by Ameritech, as more fully described in Section 3 of Schedule 12.12. (e) After completion of construction, Requesting Carrier Frontier and Ameritech will complete an acceptance walkthrough of all Collocation space requested from Ameritech. Exceptions that are noted during this acceptance walkthrough shall be corrected by Ameritech within thirty (30) days after the walkthrough. Ameritech shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at Ameritech's expense, subject to any change orders requested by Requesting CarrierFrontier. (f) Ameritech shall install Cross-Connects when cross-connecting for through connect purposes as directed by Requesting Carrier Frontier at the rates provided at Item VII of the Pricing Schedule.

Virtual Collocation. (aA) If Requesting Carrier 21st Century requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier 21st Century elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting Carrier21st Century's request, Ameritech shall include in its notice to Requesting Carrier 21st Century described in Section 12.12.1 12.12.1, (i) the space to be provided and (ii) whether Ameritech can deliver the space to Requesting Carrier 21st Century by the date set forth in Section 12.12.3(c). (bB) Ameritech and Requesting Carrier 21st Century will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier 21st Century for Virtual Collocation on the date that is the earlier of (i) ten (10) Business Days after Ameritech's verification of the Virtual Collocation space to be provided to Requesting Carrier 21st Century and (ii) fourteen (14) calendar days after Ameritech's receipt of Requesting Carrier21st Century's request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expenses. (cC) Ameritech shall deliver to Requesting Carrier 21st Century the requested space on or before the later of (i) twelve (12) weeks from Ameritech's receipt of Requesting Carrier21st Century's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech to deliver to Requesting Carrier 21st Century such space within twelve (12) weeks (such date of delivery referred to as the “"Delivery Date”") and Ameritech notified Requesting Carrier 21st Century of this fact within ten (10) Business Days after the initial walkthroughfrom Ameritech's receipt of 21st Century's request. (dD) Virtual Collocation space ordered by Requesting Carrier 21st Century will be made available to Requesting Carrier 21st Century by Ameritech, as more fully described in Section 3 of Schedule 12.12. (eE) Ameritech shall provide positive confirmation to 21st Century when construction of 21st Century Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (F) After completion of constructionconstruction and on or before but prior to the Delivery Date, Requesting Carrier 21st Century and Ameritech will complete an acceptance walkthrough of all Collocation Collocated space requested from Ameritech. Exceptions that are noted during this acceptance walkthrough shall be corrected by Ameritech within as soon as possible but not later than thirty (30) days after the walkthrough. Ameritech shall conduct a root root-cause analysis of all exceptions identified. The correction of these exceptions from the 21st Century's original request for Collocation shall be at Ameritech's expense, expense and shall be subject to any change orders requested an additional walkthrough and acceptance by Requesting Carrier21st Century. (f) Ameritech shall install Cross-Connects when cross-connecting for through connect purposes as directed by Requesting Carrier at the rates provided at Item VII of the Pricing Schedule.

Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expenses. (a) If Requesting Carrier Adelphia requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and Requesting Carrier Adelphia elects Virtual Collocation, and such Virtual Collocation is available at the time of Requesting CarrierXxxxxxxx's request, Ameritech CBT shall include in its notice to Requesting Carrier Xxxxxxxx described in Section 12.12.1 12.12.1, (i) the space to be provided and (ii) whether Ameritech CBT can deliver the space to Requesting Carrier Adelphia by the date set forth in Section 12.12.3(c). (b) Ameritech CBT and Requesting Carrier Xxxxxxxx will have an initial walkthrough of the Collocated space to be provided to Requesting Carrier Adelphia for Virtual Collocation on the date that is the earlier of (i) ten (10) Business Days after Ameritech's CBT’s verification of the Virtual Collocation space to be provided to Requesting Carrier Adelphia and (ii) fourteen (14) calendar days after Ameritech's CBT’s receipt of Requesting Carrier's Xxxxxxxx’s request for Virtual Collocation. Ameritech shall within ten (10) Business Days after such walkthrough provide Requesting Carrier with documentation submitted to and received from contractors for any work being done on behalf of Requesting Carrier that will be billed as extraordinary expenses. (c) Ameritech CBT shall deliver to Requesting Carrier Xxxxxxxx the requested space on or before the later of of (i) twelve seventy-five (1275) weeks days from AmeritechCBT's receipt of Requesting CarrierXxxxxxxx's request for Virtual Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for Ameritech CBT to deliver to Requesting Carrier Adelphia such space within twelve seventy-five (1275) weeks days (such date of delivery referred to as the “Delivery Date”) and Ameritech CBT notified Requesting Carrier Adelphia of this fact within ten (10) Business Days after the initial walkthroughfrom CBT's receipt of Xxxxxxxx's request. (d) Virtual Collocation space ordered requested by Requesting Carrier Xxxxxxxx will be made available to Requesting Carrier Adelphia by AmeritechCBT, as more fully described in Section 3 of Schedule 12.12.of (e) CBT shall provide positive confirmation to Adelphia when construction of Adelphia Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of constructionconstruction and on or before the Delivery Date, Requesting Carrier Adelphia and Ameritech CBT will complete an acceptance walkthrough of all Collocation Collocated space requested from AmeritechCBT. Exceptions that are noted during this acceptance walkthrough shall be corrected by Ameritech within CBT as soon as possible but not later than thirty (30) days after the walkthrough. Ameritech shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the Xxxxxxxx’s original request for Collocation as modified by any changes requested by Xxxxxxxx shall be at Ameritech's expense, CBT’s expense and shall be subject to any change orders requested an additional walkthrough and acceptance by Requesting CarrierXxxxxxxx. (f) Ameritech shall install Cross-Connects when cross-connecting for through connect purposes as directed by Requesting Carrier at the rates provided at Item VII of the Pricing Schedule.
