Common use of Virtual Collocation Clause in Contracts

Virtual Collocation. (a) If CLEC requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and CLEC elects Virtual Collocation, and such Virtual Collocation is available at the time of CLEC's request, SBC-AMERITECH shall include in its notice to CLEC described in Section 12.15.1: (i) the space to be provided, and (ii) whether SBC-AMERITECH can deliver the space to CLEC by the date set forth in Section 12.15.5(c). (b) SBC-AMERITECH and CLEC will have an initial walkthrough of the Collocated space to be provided to CLEC for Virtual Collocation on the earlier of: (i) ten (10) Business Days of SBC-AMERITECH's verification of the Virtual Collocation space to be provided to CLEC, and (ii) fourteen (14) calendar days after SBC-AMERITECH's receipt of CLEC's request for Virtual Collocation. SBC-AMERITECH shall within ten (10) Business Days after such walkthrough provide CLEC with: (i) documentation submitted to and received from contractors for any work being done on behalf of CLEC that will be billed as extraordinary expenses, and (ii) a parallel installation sequence. (c) SBC-AMERITECH shall deliver to CLEC the requested space on or before the later of: (i) twelve (12) weeks from SBC-AMERITECH's receipt of CLEC's request for Virtual Collocation, and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for SBC-AMERITECH to deliver to CLEC such space within twelve (12) weeks (such date of delivery referred to as the “Delivery Date”) and SBC-AMERITECH has notified CLEC of this fact within ten (10) Business Days from SBC-AMERITECH's receipt of CLEC's request. (d) Virtual Collocation space ordered by CLEC will be made available to CLEC by SBC-AMERITECH, as more fully described in the Schedules 12.12 and 12.15. (e) SBC-AMERITECH shall provide positive confirmation to CLEC when construction of CLEC-Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of construction, CLEC and SBC-AMERITECH will complete an acceptance walkthrough of all collocated space requested from SBC-AMERITECH. Exceptions that are noted during this acceptance walkthrough shall be corrected by SBC-AMERITECH within thirty (30) days after the walkthrough. SBC-AMERITECH shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at SBC-AMERITECH's expense, subject to any change orders requested by CLEC. (g) SBC-AMERITECH shall install cross-connects when cross- connecting for connect purposes as directed by CLEC at the rates provided in the Pricing Schedule. (h) SBC-AMERITECH will maintain the Virtually Collocated equipment on CLEC’s behalf.

Virtual Collocation. (a) If CLEC requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and CLEC elects Virtual Collocation, and such Virtual Collocation is available at the time of CLEC's request, SBC-AMERITECH CBT shall include in its notice to CLEC described in Section 12.15.1: 12.12.1, (i) the space to be provided, provided and (ii) whether SBC-AMERITECH CBT can deliver the space to CLEC by the date set forth in Section 12.15.5(c12.12.3(c). (b) SBC-AMERITECH CBT and CLEC will have an initial walkthrough of the Collocated space to be provided to CLEC for Virtual Collocation on the date that is the earlier of: of (i) ten (10) Business Days of SBC-AMERITECHCLEC's after CBT's verification of the Virtual Collocation space to be provided to CLEC, CLEC and (ii) fourteen (14) calendar days after SBC-AMERITECHCBT's receipt of CLEC's request for Virtual Collocation. SBC-AMERITECH shall within ten (10) Business Days after such walkthrough provide CLEC with: (i) documentation submitted to and received from contractors for any work being done on behalf of CLEC that will be billed as extraordinary expenses, and (ii) a parallel installation sequence. (c) SBC-AMERITECH CBT shall deliver to CLEC the requested space on or before the later of: of (i) twelve seventy-five (1275) weeks days from SBC-AMERITECHCBT's receipt of CLEC's request for Virtual Collocation, Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for SBC-AMERITECH CBT to deliver to CLEC such space within twelve seventy-five (1275) weeks days (such date of delivery referred to as the “"Delivery Date”") and SBC-AMERITECH has CBT notified CLEC of this fact within ten (10) Business Days from SBC-AMERITECHCBT's receipt of CLEC's request. (d) Virtual Collocation space ordered requested by CLEC will be made available to CLEC by SBC-AMERITECHCBT, as more fully described in the Schedules 12.12 and 12.15Section 3 of Schedule 12.12. (e) SBC-AMERITECH CBT shall provide positive confirmation to CLEC when construction of CLEC-CLEC Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of constructionconstruction and on or before the Delivery Date, CLEC and SBC-AMERITECH CBT will complete an acceptance walkthrough of all collocated Collocated space requested from SBC-AMERITECHCBT. Exceptions that are noted during this acceptance walkthrough shall be corrected by SBC-AMERITECH within CBT as soon as possible but not later than thirty (30) days after the walkthrough. SBC-AMERITECH shall conduct a root cause analysis of all exceptions identified. The correction by CBT of these any exceptions noted by CLEC, from the CLEC's original request for Collocation collocation (as modified by any changes requested by CLEC), shall be at SBC-AMERITECHCBT's expense, expense and shall be subject to any change orders requested an additional walk through and acceptance by CLEC. (g) SBC-AMERITECH shall install cross-connects when cross- connecting for connect purposes as directed by CLEC at the rates provided in the Pricing Schedule. (h) SBC-AMERITECH will maintain the Virtually Collocated equipment on CLEC’s behalf.

Virtual Collocation. (c) SBC-AMERITECH Ameritech shall deliver to CLEC the requested space on or before the later of: of (i) twelve (12) weeks from SBC-AMERITECHAmeritech's receipt of CLEC's request for Virtual Collocation, Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for SBC-AMERITECH Ameritech to deliver to CLEC such space within twelve (12) weeks (such date of delivery referred to as the “(Delivery Date”) ? and SBC-AMERITECH has Ameritech notified CLEC of this fact within ten (10) Business Days from SBC-AMERITECHAmeritech's receipt of CLEC's request. (d) Virtual Collocation space ordered by CLEC will be made available to CLEC by SBC-AMERITECHAmeritech, as more fully described in the Schedules 12.12 and 12.15Section 3 of Schedule 12.12. (e) SBC-AMERITECH Ameritech shall provide positive confirmation to CLEC when construction of CLEC-Collocated collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of construction, CLEC and SBC-AMERITECH Ameritech will complete an acceptance walkthrough of all collocated Collocated space requested from SBC-AMERITECHAmeritech. Exceptions that are noted during this acceptance walkthrough shall be corrected by SBC-AMERITECH Ameritech within thirty (30) days after the walkthrough. SBC-AMERITECH Ameritech shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at SBC-AMERITECHAmeritech's expense, subject to any change charge orders requested by CLEC. (g) SBC-AMERITECH Ameritech shall install cross-connects when cross- cross-connecting for thru connect purposes as directed by CLEC at the rates provided in at Item VII of the Pricing Schedule. (h) SBC-AMERITECH will maintain the Virtually Collocated equipment on CLEC’s behalf.

Virtual Collocation. (d) Virtual Collocation space ordered by CLEC will be made available to CLEC by SBC-AMERITECH, as more fully described in the Schedules 12.12 and 12.15. (e) SBC-AMERITECH shall provide positive confirmation to CLEC when construction of CLEC-Collocated CLEC -Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include inc lude a process for determining when construction is fifty percent (50%) complete. (f) After completion of construction, CLEC and SBC-AMERITECH will complete an acceptance walkthrough of all collocated space requested from SBC-AMERITECH. Exceptions that are noted during this acceptance walkthrough shall be corrected by SBC-AMERITECH within thirty (30) days after the walkthrough. SBC-AMERITECH shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the original request for Collocation shall be at SBC-AMERITECH's expense, subject to any change orders requested by CLEC. (g) SBC-AMERITECH shall install cross-connects when cross- connecting for connect purposes as directed by CLEC at the rates provided in the Pricing ScheduleSchedule . (h) SBC-AMERITECH will maintain the Virtually Collocated equipment on CLEC’s behalf.

Virtual Collocation. (a) If CLEC Sprint requests Virtual Collocation, or if requested Physical Collocation space is not available at a Premises and CLEC Sprint elects Virtual Collocation, and such Virtual Collocation is available at the time of CLECSprint's request, SBC-AMERITECH CBT shall include in its notice to CLEC Sprint described in Section 12.15.1: 12.12.1, (i) the space to be provided, provided and (ii) whether SBC-AMERITECH CBT can deliver the space to CLEC Sprint by the date set forth in Section 12.15.5(c12.12.3(c). (b) SBC-AMERITECH CBT and CLEC Sprint will have an initial walkthrough of the Collocated space to be provided to CLEC Sprint for Virtual Collocation on the date that is the earlier of: of (i) ten (10) Business Days of SBC-AMERITECH's after CBT=s verification of the Virtual Collocation space to be provided to CLEC, Sprint and (ii) fourteen (14) calendar days after SBC-AMERITECH's CBT=s receipt of CLEC's Sprint=s request for Virtual Collocation. SBC-AMERITECH shall within ten (10) Business Days after such walkthrough provide CLEC with: (i) documentation submitted to and received from contractors for any work being done on behalf of CLEC that will be billed as extraordinary expenses, and (ii) a parallel installation sequence. (c) SBC-AMERITECH CBT shall deliver to CLEC Sprint the requested space on or before the later of: of (i) twelve seventy-five (1275) weeks days from SBC-AMERITECHCBT's receipt of CLECSprint's request for Virtual Collocation, Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for SBC-AMERITECH CBT to deliver to CLEC Sprint such space within twelve seventy-five (1275) weeks days (such date of delivery referred to as the “Delivery Date”ADelivery Date@) and SBC-AMERITECH has CBT notified CLEC Sprint of this fact within ten (10) Business Days from SBC-AMERITECHCBT's receipt of CLECSprint's request. (d) Virtual Collocation space ordered requested by CLEC Sprint will be made available to CLEC Sprint by SBC-AMERITECHCBT, as more fully described in the Schedules 12.12 and 12.15Section 3 of Schedule 12.12. (e) SBC-AMERITECH CBT shall provide positive confirmation to CLEC Sprint when construction of CLEC-Sprint Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of constructionconstruction and on or before the Delivery Date, CLEC Sprint and SBC-AMERITECH CBT will complete an acceptance walkthrough of all collocated Collocated space requested from SBC-AMERITECHCBT. Exceptions that are noted during this acceptance walkthrough shall be corrected by SBC-AMERITECH within CBT as soon as possible but not later than thirty (30) days after the walkthrough. SBC-AMERITECH shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the Sprint=s original request for Collocation as modified by any changes requested by Sprint shall be at SBC-AMERITECH's expense, CBT=s expense and shall be subject to any change orders requested an additional walkthrough and acceptance by CLECSprint. (g) SBC-AMERITECH shall install cross-connects when cross- connecting for connect purposes as directed by CLEC at the rates provided in the Pricing Schedule. (h) SBC-AMERITECH will maintain the Virtually Collocated equipment on CLEC’s behalf.

(b) SBC-AMERITECH CBT and CLEC Sprint will have an initial walkthrough of the Collocated space to be provided to CLEC Sprint for Virtual Collocation on the date that is the earlier of: of (i) ten (10) Business Days of SBC-AMERITECH's after CBT=s verification of the Virtual Collocation space to be provided to CLEC, Sprint and (ii) fourteen (14) calendar days after SBC-AMERITECH's CBT=s receipt of CLEC's Sprint=s request for Virtual Collocation. SBC-AMERITECH shall within ten (10) Business Days after such walkthrough provide CLEC with: (i) documentation submitted to and received from contractors for any work being done on behalf of CLEC that will be billed as extraordinary expenses, and (ii) a parallel installation sequence. (c) SBC-AMERITECH CBT shall deliver to CLEC Sprint the requested space on or before the later of: of (i) twelve seventy-five (1275) weeks days from SBC-AMERITECHCBT's receipt of CLECSprint's request for Virtual Collocation, Collocation and (ii) such other reasonable date that the Parties may agree upon if it is not feasible for SBC-AMERITECH CBT to deliver to CLEC Sprint such space within twelve seventy-five (1275) weeks days (such date of delivery referred to as the “A Delivery Date”Date@ ) and SBC-AMERITECH has CBT notified CLEC Sprint of this fact within ten (10) Business Days from SBC-AMERITECHCBT's receipt of CLECSprint's request. (d) Virtual Collocation space ordered requested by CLEC Sprint will be made available to CLEC Sprint by SBC-AMERITECHCBT, as more fully described in the Schedules 12.12 and 12.15Section 3 of Schedule 12.12. (e) SBC-AMERITECH CBT shall provide positive confirmation to CLEC Sprint when construction of CLEC-Sprint Collocated space is fifty percent (50%) completed. This confirmation shall also include confirmation of the scheduled completion date and the Delivery Date. The Implementation Plan will include a process for determining when construction is fifty percent (50%) complete. (f) After completion of constructionconstruction and on or before the Delivery Date, CLEC Sprint and SBC-AMERITECH CBT will complete an acceptance walkthrough of all collocated Collocated space requested from SBC-AMERITECHCBT. Exceptions that are noted during this acceptance walkthrough shall be corrected by SBC-AMERITECH within CBT as soon as possible but not later than thirty (30) days after the walkthrough. SBC-AMERITECH shall conduct a root cause analysis of all exceptions identified. The correction of these exceptions from the Sprint=s original request for Collocation as modified by any changes requested by Sprint shall be at SBC-AMERITECH's expense, CBT=s expense and shall be subject to any change orders requested an additional walkthrough and acceptance by CLECSprint. (g) SBC-AMERITECH shall install cross-connects when cross- connecting for connect purposes as directed by CLEC at the rates provided in the Pricing Schedule. (h) SBC-AMERITECH will maintain the Virtually Collocated equipment on CLEC’s behalf.
