Common use of Voluntary Requests for Assistance Clause in Contracts

Voluntary Requests for Assistance. The City shall not terminate an employee the first time he/she voluntarily seeks treatment, counseling, or other support for an alcohol or drug related problem; the City may require reassignment of the employee with pay if he is then unfit for duty in his current assignment. The City shall make available through appropriate agencies a means by which the employee may obtain referrals and treatment. All such requests shall be confidential and any information received by the City, through whatever means, shall not be used in any manner adverse to the employee’s interests, except reassignment as described above. The foregoing shall not be construed as an obligation on the part of the City to retain an employee on active status throughout the period of rehabilitation if it is appropriately determined that the employee’s current use of alcohol or drugs prevents such individual from performing the duties of the fire department employee or whose continuance on active status would constitute a direct threat to the property or safety of others. Such employees shall be afforded the opportunity to. use accumulated paid leave or take an unpaid leave of absence pending treatment. Employees who are taking prescribed or over-the-counter medication that has adverse side effects which interfere with the employees’ ability to perform his normal duties may be temporarily reassigned with pay to other more suitable fire duties.
