Waive. The failure of the University to insist upon a strict performance of any term or condition of this contract or to exercise any right conferred by this contract will not be considered a relinquishment of the right to do so.

Waive. Any failure on the part of any party hereto to comply with any its or their obligations, agreements or conditions hereunder may be waived in writing by the party to whom such compliance is owed.
Waive. No conduct by either party, except for express and written waive, shall constitute waive concerning any provision of this Agreement. The delay by either party to enforce its rights or powers shall not be regarded as waive of such rights or powers, and the individual or partial enforcement, by either party, of any of such rights or powers shall not impair future or additional enforcement of such right or power. Any timely waive of a right or power shall not be construed, in any event, as waive of or limitation to rights or powers and any other events.
