Waiver of Líability for Launch Services. Customer hereby agrees to a no-fault, no subrogation waiver of liability and waiver of any right to xxx or otherwise bring a claím against 03b's or SSM's launch services provider that is launching the Satellite System or the government agency that has responsibility for such launch services provider, their respective contractors and subcontractors at every tíer that are involved in activities relating to the launch services and theír respective directors, officers, employees and agents or any person or entity that has any right, title or interest in the launch vehicle used to provide the launch services (collectively, the "Launch Third Parties"), for any financia! 1oss Customer may sustain or for any bodily injury, death, property loss or damage sustained by Customer or íts employees, officers, directors, agents or customers (collectively, the "Customer Parties"), arising in any manner out of or in connection with any launch sen/ices performed for the launching of the Satellite System. Such waiver will apply regardless of the theory of liability, whether based in contract or tort, including negligence, product liability and strict liability, or any other theory of liability. Customer shall obtain a waiver of subrogation rights it may have against the Launch Third Parties from its insurers providing any coverage for any iníury, death, loss or damage. In the event that any of the Customer Parties proceed against any of the Launch Third Parties as a result of any bodily injury, death, property loss or damage or other finaricial loss suffered by any of the Customer Parties and caused by any of the Launch Third Parties in connection with the performance of the launch services, Custorner shall defend, indemnify, and hold harmless ali members of the 03b Group from and against any and ali direct or indirect claims, líabilities, losses, costs, damages, judgments, penalties, interest and expenses (lncluding reasonable attorneys' fees and costs) of or by the launch services provider or by any of the Launch Third Parties.
