WARRANTY PRODUCTS. Seller shall not limit or exclude any implied warranties and any attempt to do so shall render this contract voidable at the option of the City. Seller warrants that the goods furnished will conform to the specifications, drawings, and descriptions listed in the bid invitation, and to the sample(s) furnished by Seller, if any. In the event of a conflict between specifications, drawings, and descriptions, the specifications shall govern.
WARRANTY PRODUCTS. (a) The Seller expressly warrants that the articles shall be merchantable within the meaning of Article 2-314 (2) of the Uniform Commercial Code in effect on the date of this order. In addition to all warranties which may be prescribed by law, the articles shall conform to specifications, drawings, and other description and shall be free from defects in materials and workmanship. Seller also warrants that to the extent the articles are not manufactured pursuant to detailed designs furnished by Buyer, that they will be free from defects in design. Such warranties including warranties prescribed by law, shall run to Buyer, its successors, assigns, and customers, and to users of the articles. Seller acknowledges that all upholstered furniture at minimum meets California Technical Bulletins 116 and 117.
WARRANTY PRODUCTS. Vendor shall not limit or exclude any implied warranties and any attempt to do so shall render this Contract voidable at the option of County. Vendor warrants that the goods furnished will conform to the specifications, drawings and descriptions provided in Exhibit “A” and County’s solicitation, if applicable. Additionally, Vendor warrants that all goods are free from defects in material and workmanship.
