Withholding FundsThe Department reserves the right to withhold payments pending timely delivery of program and project reports or documents as may be required under this Agreement, and for defaults by the Subrecipient and/or Developer, as noted in Exhibit D.
Withholding FundsIn the event that the Employee shall owe an obligation of any type whatsoever to SRA at any time during or after the termination of employment hereunder, then, subject to any mandatory provisions of law, the Employee expressly authorizes SRA to withhold or deduct an amount equal to said obligation from any wages due to the Employee back from SRA or any amounts due hereunder. For purposes of this provision, wages shall mean any remuneration, compensation, bonus, commission, and/or fringe benefit provided in return for services provided by the Employee.
Withholding Funds. This remedy may be applied in situations where the School could reasonably take actions to remedy the breach prior to the withholding of funds. The District may only withhold funds in situations as allowed by C.R.S. § 22-30.5-105(2)(c)(IV). Starting from the second month, based on Party B's revenue on the payment gateway, the parties will agree on a separate arrangement for withholding funds and holding duration. ● If Stripe itself holds funds due to unusual account changes (e.g., a sudden revenue increase, or suspicions of non-fulfillment), usually 25% of daily revenue for 90 days, Party A will not hold additional funds.

Payments are contingent upon the Grantee's and its Subrecipient’s financial management system meeting the requirements of 2 CFR 200.302 and the internal control requirements of 2 CFR 200.303. Payments to the Grantee may be suspended or terminated, in whole or in part, by the Department in its sole discretion in the event of a default by Grantee or its Subrecipients.
