Withholding of Funds. The Contracting Officer, upon his/her own action or upon request of HUD, shall withhold or cause to be withheld from the Contractor under this Contract or any other contract subject to HUD-determined wage rates, with the same prime Contractor, so much of the accrued payments or advances as may be considered necessary to pay laborers and mechanics employed by the Contractor or any subcontractor the full amount of wages required by this clause. In the event of failure to pay any laborer or mechanic employed under this Contract all or part of the wages required under this Contract, the Contracting Officer or HUD may, after written notice to the Contractor, take such action as may be necessary to cause the suspension of any further payment or advance until such violations have ceased. The Public Housing Agency or HUD may, after written notice to the Contractor, disburse such amounts withheld for and on account of the Contractor or subcontractor to the respective employees to whom they are due.
Withholding of Funds. HUD or its designee shall, upon its own action or upon written request of an authorized representative of the Department of Labor, withhold or cause to be withheld from the Contractor under this contract or any other Federal contract with the same prime Contractor, or any other Federally-assisted contract subject to Xxxxx-Xxxxx prevailing wage requirements, which is held by the same prime Contractor, so much of the accrued payments or advances as may be considered necessary to pay laborers and mechanics, including apprentices, trainees, and helpers, employed by the Contractor or any subcontractor the full amount of wages required by the contract. In the event of failure to pay any laborer or mechanic, including any apprentice, trainee, or helper, employed or working in the construction or development of the project, all or part of the wages required by the contract, HUD or its designee may, after written notice to the Contractor, take such action as may be necessary to cause the suspension of any further payment, advance, or guarantee of funds until such violations have ceased. HUD or its designee may, after written notice to the Contractor, disburse such amounts withheld for and on account of the Contractor or subcontractor to the respective employees to whom they are due. the registration of apprenticeship programs and certification of trainee programs, the registration of the apprentices and trainees, and the ratios and wage rates prescribed in the applicable programs.
(i) The Contractor shall submit weekly for each week in which any contract work is performed a copy of all payrolls to the Contracting Officer for transmission to HUD or its designee. The payrolls submitted shall set out accurately and completely all of the information required to be maintained under subparagraph (c)(1) of this clause. This information may be submitted in any form desired. Optional Form WH- 347 (Federal Stock Number 029-005-00014-1) is available for this purpose and may be purchased from the Superintendent of Documents, U.S. Government Printing Office, Washington, D.C. 20402. Withholding of Funds. In the event that the City fails, neglects, or refuses to enact, keep in force or enforce ordinances specified or enacts ordinances contrary to the provisions in this Agreement, or in any other manner fails, neglects or refuses to perform any of the obligations assumed by it under this Agreement, the Commission may, after serving written request upon the City for compliance and the City's failure to comply, withhold the expenditure of further funds for maintenance, improvement, construction, or reconstruction of the state highway system in the City.
Withholding of Funds. 1. The department may authorize the withholding of a grant payment where the department determines, in writing, that a grantee has failed to comply with project objec- tives, grant award conditions or reporting requirements. With- holding shall be limited to only that amount necessary to assure compliance.
2. The department shall withhold payment of the amount of any indebtedness to the department, unless the department deter- mines that collection of the debt will impair accomplishment of the project objectives and that continuation of the project is in the best interest of the program.

County may withhold all or any portion of Funds not yet disbursed pursuant to this Agreement or any other agreement with Recipient, regardless of whether Recipient has previously submitted an Application or whether County has approved a disbursement of Funds requested in any Application or funding request.
Withholding of Funds. In accordance with Idaho Code § 67-7448(1), willfully withholding of funds is a violation of Idaho law and the violating Retailer may be fined up to $5,000 or imprisoned up to six (6) months or be both fined and imprisoned.

In addition to any other provisions of this Agreement including but not limited to Exhibits A and D, TriMet may withhold payment of STIF Discretionary Funds if the funds are not being used in accordance with ORS 184.751 through 184.766, OAR Chapter 732, or this Agreement, all required reporting has not been submitted, or there are any unresolved audit findings relating to the use of STIF Discretionary Funds. Subrecipient shall assure that funds allocated hereunder are used only for the purposes permitted, and assumes responsibility for breach of conditions of the STIF Discretionary Funding requirements hereunder by Subrecipient, and shall, upon breach of conditions that require TriMet to return funds to the Section, hold harmless and indemnify TriMet for an amount equal to the funds required to be repaid plus any additional costs incurred by TriMet.
Withholding of Funds. In the event the Charter School fails to submit to the Board any documents or information required under this Agreement, or fails to follow any law, regulation, procedure and/or policy referenced in this Agreement, excepting reasonable delay due to physical plant casualties, technological failures or circumstances beyond the Charter School’s control, the Board may withhold up to 50% of any and all payments of funds to the Charter School providing the Board gives the Charter School written notice enumerating the specific failure(s). Upon the Charter School’s compliance with any such failure(s), the Board shall immediately release any and all payments of funds due the Charter School.

Payments may be withheld because of: (1) defective Work not remedied; (2) failure of Contractor to make proper payments to subcontractors, workers, or suppliers; (3) persistent failure to carry out Work in accordance with this Agreement or these general conditions, or (4) legal claims. Final payment will be due only upon release of any and all liens arising out of the Agreement or submission of receipts or other evidence of payment covering all subcontractors or suppliers who could file such a lien. The Contractor agrees to indemnify the Borrower and Lender against such liens and will refund all monies including costs and reasonable attorney’s fees paid by the Borrower and/or Lender in discharging the liens. A ten (10) percent “Holdback” reserve is required by the Lender to assure the Work has been properly completed and there are no liens on the Property.
