XXX Use of the City Police Radio System. At no cost to the City, the XXX may access and use the Sponsored Channels. The XXX’x access and use of the Sponsored Channels under this Agreement is non-exclusive and is always secondary to the City’s access and use of the Sponsored Channels. The XXX shall always access and use the Sponsored Channels in accordance with all applicable laws. Unless otherwise determined in writing by the City Chief of Police or by the City Chief of Police’s designee, the XXX will always comply the following: ⮚ The XXX may use no more than five radios on the Sponsored Channels. ⮚ The XXX at its cost will purchase its own XXX radios to access the Sponsored Channels. ⮚ The XXX will work through SNO911 (and not the City) to manage XXX radios. ⮚ The XXX will only utilize radio communications on the Sponsored Channels for immediate, emergent situations. All non-emergent issues must be addressed through the City’s non-emergency line (425-407-3999) or 911. ⮚ The XXX will not use the Sponsored Channels for internal XXX communications. ⮚ The XXX will vet all personnel (currently employed as well as newly hired) who access or use the Sponsored Channels or who will use XXX radios that can access the Sponsored Channels. This vetting will include criminal background checks. All such personnel must meet the background-check standards of non-criminal behavior required of commissioned officers. ⮚ In the event of lost, damaged, or stolen radios, the XXX (and not the City) will bear the sole responsibility to notify SNO911. ⮚ The XXX will keep XXX radios secured and not accessible to non-vetted employees or to anyone else. ⮚ The XXX will ensure that all XXX radio users are familiar with and follow proper radio procedures on the Sponsored Channels. ⮚ The XXX will have SNO911 disable the EMIRs in the XXX radios before the XXX radios access the Sponsored Channels. ⮚ The XXX will work with SNO911 so that SNO911 provides routine radio updates and programming to the XXX. ⮚ The XXX will obtain the radio procedures manual from SNO911. The XXX will comply with the manual (and all manual updates) in the XXX’x access to and use of the Sponsored Channels. ⮚ The XXX will use reasonable efforts to obtain an inter-operability channel from SNO911. The City Chief of Police or the City Chief of Police’s designee may impose additional requirements and limitations on the XXX.

  • Use of the Card 1. The Cardmember must sign the Card in ink, using a ball point pen, as soon as he or she receives it; the Cardmember must also safeguard the Card and preserve any PIN in extreme secrecy and keep it separate from his or her Card. The Cardmember must not use the Card after the expiration of the validity period embossed on it, and not use the Card after it has been damaged, withdrawn or cancelled.

  • Emergency Standby for Goods and/or Services If any Federal or State official, having authority to do so, declares an emergency or the occurrence of a natural disaster within the State of Connecticut, DAS and the Client Agency may request the Goods and Services on an expedited and prioritized basis. Upon receipt of such a request the Contractor shall make all necessary and appropriate commercially reasonable efforts to reallocate its staffing and other resources in order to give primary preference to Performing this Contract ahead of or prior to fulfilling, in whole or in part, any other contractual obligations that the Contractor may have. The Contractor is not obligated to make those efforts to Perform on an expedited and prioritized basis in accordance with this paragraph if doing so will make the Contractor materially breach any other contractual obligations that the Contractor may have. Contractor shall acknowledge receipt of any request made pursuant to this paragraph within 2 hours from the time that the Contractor receives it via purchase order or through a request to make an expedited or prioritized purchase through the State of Connecticut Purchasing Card (MasterCard) Program (the “P-Card Program”). If the Contractor fails to acknowledge receipt within 2 hours, confirm its obligation to Perform or actually Perform, as set forth in the purchase order or through the P-Card Program, then DAS and the Client Agency may procure the Performance from another source without further notice to Contractor and without creating any right of recourse at law or in equity against DAS or Client Agency.

  • Scaling Locations, Rules, and Organizations All logs from timber sold under the terms and conditions of this contract shall be: (1) scaled at a location approved in writing by STATE; (2) scaled by a third-party scaling organization with a current agreement with STATE; and (3) scaled using the Official Log Scaling and Grading Rules (as adopted by the Northwest Log Rules Advisory Group) and STATE special service scaling instructions in effect at the time the logs are scaled. Utilization scale shall be handled in accordance with the section titled, “Utilization Scale.” PURCHASER shall enter into a written agreement with a third-party scaling organization for the scaling of logs removed from the timber sale area. PURCHASER shall furnish STATE with a copy of the scaling agreement upon request. If logs are delivered when a TPSO scaler is not present, PURCHASER must provide STATE with a method to assure protection and accountability. PURCHASER shall provide STATE with remote check scaling opportunities for logs scaled under this contract. The last two loads at each delivery point shall be continuously available for checking. They shall remain available for a minimum of 48 hours unless replaced by other STATE loads. They shall be available as originally presented for scaling; i.e., if truck scaled, they shall be presented in bunks. In the event scaling is suspended for any reason, hauling operations shall be immediately suspended until approved alternate scaling services are provided, or service by the scaling organization is resumed.
