XXXX Claims. If either party receives (and determines in good faith the validity of) any third-party claim that your App(s) violate any XXXX license terms, then you agree to promptly remedy the basis for the claim (e.g., provide missing notices or attributions, deliver underlying source code, etc.) and/or Update the App to remove the XXXX that is the basis for the claim.

XXXX Claims. Xxxx claims for unauthorized time shall be honored and paid in accordance with applicable rates of pay when presented in writing to the Employer or his representative where it can be established between the Union and the Employer or his representative that work was performed during such time. In no case shall claim for such unauthorized time exceed six (6) months. Employees who work unauthorized time shall be subject to the procedures set forth in Article 3 - Suspension, Dismissal and Demotion - of this Agreement and all employees shall be so notified. Except as may be provided otherwise in this Agreement, all wage claims shall be limited to a maximum of a six (6) month period.
XXXX Claims. SUBCONTRACTOR agrees that it will promptly remove or bond off any and all liens arising out of its Work except to the extent such lien is caused by VIEW payment defaults. If SUBCONTRACTOR fails to promptly remove or bond off any lien, VIEW reserves the right to remove or bond off the lien, and SUBCONTRACTOR agrees to reimburse or indemnify VIEW for all costs incurred by VIEW, including attorney’s fees. Further, if such lien is arbitrated or litigated, SUBCONTRACTOR agrees to pay all VIEW reasonable attorney’s fees and any amounts to satisfy a resulting settlement, judgment, or award.
XXXX Claims. Control of Additional 16 Unpatented Mining Claims surrounding the above referenced claims; Arizona controls an additional 16 unpatented lode mining claims surrounding the above referenced leased claims that were staked and are held by Arizona’s Chairman and CEO in trust for the benefit of Arizona. Arizona makes all annual BLM claim maintenance payments and controls 100% of these claims free and clear of any obligation to the claimant. There is an assignment and assumption agreement in place that transfers these claims to Arizona Silver upon Arizona Silver establishing a US subsidiary that can legally hold claims in the US. List of Claims The table below sets out all of the claims comprising the Arizona Properties:

  • Covered Claims Claim" means any claim, dispute or controversy between you and us that in any way arises from or relates to this Agreement, the Account, the issuance of any Card, any rewards program, any prior agreement or account.   • Disputed Claims 4.1 Notwithstanding paragraph 4.5 of this Schedule, payment by the Authority of all or any part of any invoice rendered or other claim for payment by the Contractor shall not signify approval of such invoice/claim.   • RETURNS, CLAIMS, REFUNDS The customer shall immediately upon receipt of goods supplied fully inspect such goods and satisfy itself that the goods are correct. If the customer is unsatisfied, the customer must immediately contact the Company and communicate all details of such dissatisfaction. Unless the above procedure is followed the Company is entitled to assume that the goods supplied are correct and no returns claims for refunds will be permitted or made.

  • Final Claims 5.1 Provided all previous claims have been paid, the authority shall have no further liability to make payment of any kind to the contractor once the final claims have been paid.   • Warranty Claims This Contractual Warranty is provided by Xxxxxxxxx Electric and covers defects in workmanship and materials in your Product. This warranty period lasts from the date of purchase at the point of sale to you, the original end user, unless otherwise agreed in writing (the "Warranty Period").   • FALSE CLAIMS Contractor warrants that it shall not, with respect to this Contract, make or present any claim upon or against the Government of the Virgin Islands, or any officer, department, board, commission, or other agency thereof, knowing such claim to be false, fictitious or fraudulent. Contractor acknowledges that making such a false, fictitious, or fraudulent claim is an offense under Virgin Islands law.

  • NO EXTRA CLAIMS The Employees and the Union shall not pursue any extra claims, either Award or over Award for the life of the Agreement. Without limiting the generality of the foregoing, there shall be no industrial action for the purpose of supporting or advancing claims against the company in relation to the above, until the Agreement's nominal expiry date has passed. Where any disagreement arises, the parties shall follow the Dispute Settlement Procedure contained in this Agreement.
