XXXXX’S LEGAL OPINIONS. Employees with a 5-day week are entitled to - “Post search days” in accordance with Section 2 item 6 and - paid days in the event of absence from work for important personal reasons in accordance with Section 5 item 3 to the extent stated there. In these cases, employees with a 1-, 2-, 3- or 4-day week are entitled to paid time off to a reduced extent, otherwise they would be favoured without any objective reason (for more information see footnotes 5 and 22). For reasons of works constitution law and objective considerations, contrary to the wording of - Section 4 item 27 para 1 shift work as well - Section 4 item 35 para 1 a reduction in the normal weekly working hours for all employees or for groups can also be agreed individually without the consent of the works council or the parties to the collective agreement (for more information see footnotes 14 and 19).
