Xxxxxx for excessive downtime. If the ScanPoint Service fails to meet the “Uptime Warranty” requirement, a Client may request a reduction in fee payable to Verathon for that month as specified in the ScanPoint Fees. Other than termination of this Agreement as authorized by “Termination” section of this agreement, said fee reduction will be Client’s sole remedy for Verathon’s failure to meet its uptime warranty as defined in section 3.8.3 of this Agreement.
