Excessive Use definition

Excessive Use means the number of users in the Platform is above and beyond a reasonable expectation, or use constituting an undue burden as determined by HSI, including use with detrimental or disruptive impact to information technology infrastructure, and use which may result in interruption to software services, product delivery, general customer service obligations to other HSI customers, or additional fees for continued usage over the established limit.
Excessive Use means your usage of the Silverline Web Application Firewall Service (a) in excess of the bandwidth provided for in the applicable Order, as measured by us where use shall be excessive if either (i) the 95th Percentile Calculated Bandwidth exceeds the applicable tier defined in the Order; or (ii) you are targeted by a sustained DDoS attack whereby your application consumes more than one DDoS attack that exceeds a peak of 1.5 Gbps of attack traffic during any twelve (12) month period, unless you have an effective subscription to Silverline DDoS Protection SaaS Offerings covering such attack or (b) where you have provisioned a quantity of FQDNs for protection via the Silverline Web Application Firewall Service greater than the defined amount of FQDNs in the Order. You acknowledge and agree that our obligations are limited to providing the Silverline Web Application Firewall SaaS Offerings in the quantiles identified in the Order(s) for the active Service Term(s).

More Definitions of Excessive Use

Excessive Use means high out of pattern use of the Service in a short term period or a sustained high usage which exceeds the general average usage of customers on a similar Service Schedule or Pricing Schedule. Force Majeure Event means any event or circumstance reasonably beyond our control, including but not limited to; war, accident, civil commotion, riot, military action, sabotage, act of terrorism, vandalism, embargo, judicial action, labour dispute, an act of a government or a government authority, acts of God, earthquake, fire, flood, storm, plague or other natural calamity, computer viruses, hacker attacks, failure of the internet, failure in electrical power supply, failure of air- conditioning or humidity control, cut cables, or delay, failure or default by any other supplier. Excessive Use of a Silverline SaaS Offering shall have the meaning set forth in the applicable Service-Specific Term.
Excessive Use means your usage of the Silverline DDoS Protection Service in (a) excess of the Clean Bandwidth as measured by 95th Percentile Calculated Bandwidth; or (b) your configuration of Router Monitoring or Data Centers (e.g., GRE Tunnels) exceeds the quantities defined in the applicable Order.

Threat Data does not include information that identifies a natural person.

Excessive Use of a Service shall have the meaning as set forth in the applicable Addendum for such Service.
Excessive Use. Voice & data ( Mega Fibre) You must not use any of services in any way at the complete discretion of Axecom that we deem to be excessive. Excessive use would be if you used more than the average of a normal months usage averaged over the previous 3 months. We also consider it excessive if you used any single or aggregated components [local calls, long distance or calls or Data etc] of your service more than the total average of a normal month’s usage for the same component averaged over the previous 3 months. Excessive use would include using services provided by Axecom for any form of telemarketing; excessive use would also include changing your services to include other users on the same service. These would include allowing different users to access and use the service that normally didn’t use the service. Should Axecom find your usage to be excessive, and in breach of our Fair Use Policy we will begin to charge your service at our standard rates for a similar service for your usage. Axecom may then ask you to reduce your usage. If usage continues at an excessive level following this request, we may refuse you access to our discounted or capped rates and you will then be continued to be charged at our standard rates for a similar service for your usage. Unreasonable use: You must not seek out ways or invent methods that are not part of your normal business activity when you previously used this service. We think it is unreasonable if you use the ‘included’ or discounted service for purposes other than for your business or personal use. Axecom also considers any service that is connected to or associated with a device that alters the normal use of the service as unreasonable use. Axecom includes using the service in connection with a device that automatically transmits or receives data or other information as unreasonable use. If we consider your use of our ‘included’ or discounted service is unreasonable we may refuse you access to our discounted, special plan or capped rates and you will then be charged at our standard rates for a similar service for your usage.
