A copy of the registered letter will be provided for the Plant Chairperson at the time of mailing.

XXXXXX & RECALL. 14.1 When 4:01 In recognition of the Company deems Employer’s responsibility for efficient operations it is understood and agreed that ability to perform the situation is essential and shall apply in a layoff in a recall, promotion and demotion.
4:02 Whenever the Employer decides it is necessary to reduce staff, employees will be laid off in each classification on the workforce basis of the reverse order of the total length of service since last hired provided those remaining are qualified to perform the work required.
4:03 An employee in a classification being reduced in number may elect to go into a lower classification at the highest rate for up that classification, provided that he/she is qualified for the work required and that his/her total service with the Employer exceeds that of another employee in the lower classification who becomes the employee to be laid off.
4:04 If an employee accepts a promotion to a higher classification, he/she shall be permitted to return to his original position if he so decides within a one (1) daymonth period. The Employer shall have the right to return the employee to his former position if he is not qualified for the higher position.
4:05 Employees laid off due to a reduction in force shall have preferential rights for rehiring for eight months. A list shall be maintained by the Employer and when hiring for situations covered by this Agreement, the Employer shall give preference in hiring to such persons in inverse order to that in which they were laid off.
4:06 Notice of recall shall be sent to the individual by registered mail in the last known address, a copy of which shall be forwarded to the Union. Recalled employees shall have two weeks from the date of posting to report for duty. Severance
4:07 An employee who has completed three years of service and who is terminated as a result of staff reductions shall receive a severance pay in the amount of one and a half (1.5) week’s pay for each year of service or major fraction thereof, to a maximum of 26 weeks. XXXXXX & RECALL. 14.1 When the Company deems it necessary to reduce the workforce for up to 15.01 A “layoff” shall be defined as a minimum of one (1) daycomplete shift. A Record of Employment (XXX) will be issued where the definition of a layoff under the Employment Insurance Act has been met, in order for the employee to qualify for Employment Insurance benefits if the employee elects to accept the layoff. If the employee does not elect to accept the layoff and decides instead to displace, or accepts a temporary position, or chooses to use available vacation or lieu time to maintain income, an XXX will not be issued unless vacation and lieu time has been exhausted.
15.02 A seniority employee who is subject to layoff may exercise seniority by displacing an employee who has less seniority in accordance to the provisions of Article 13.04.
15.03 Should it become necessary for the Employer to reduce staff, the Employer would first solicit voluntary resignations from among existing staff. Should there be no voluntary resignations, layoffs shall occur according to the provisions of Article 13.04.
15.04 In order to avoid a layoff, employees who may accept a part-time or relief position will retain their seniority and remain in the permanent section of the seniority list for the purposes of entitlement to recall.
15.05 When there is a closure of a program which results in a layoff:
(a) The Employer agrees to permit employees to fill vacancies caused by vacation on a temporary basis in order to reduce the impact of the layoff, provided the employee meets the qualifications as required in Article 13.04(b);
(b) In order to further reduce the impact of a program closure on the Employer and its employees, all staff may access their earned and accrued vacation time or earned lieu time during the period of the closure;
(c) In order to further reduce the impact of a program closure on the Employer and its employees, staff may elect to accept a voluntary layoff without income during the period of closure;
(d) The Employer agrees to back-fill the positions vacated by vacationing adult program employees only in the event of a program closure pursuant to this Article and only to a maximum of four (4) employees;
(e) The Employer agrees to back-fill the positions vacated by vacationing residential program employees to a maximum of two (2) employees per group home;
(f) For employees who back-fill any positions vacated by vacationing employees, current group insurance benefit levels will be offered laymaintained;
(g) For the employees who are laid-off on off, voluntarily or otherwise, and choose not to back-fill positions vacated by vacationing employees and in order to maintain their existing group benefit levels the following applies:
(i) the Employer will pay fifty percent (50%) of the premium costs of the employee’s group benefit plan for the first month of layoff. The employee’s fifty percent (50%) will be deducted from the employee’s last pay period prior to the layoff;
(ii) where a voluntary basis by seniority in layoff is expected to exceed one (1) month, the employee is required to pay one hundred percent (100%) of their classification/shift/department. group benefit premium for the remainder of the layoff;
(iii) subject to the restrictions or requirements of the group benefit plan, if the layoff is expected to exceed one (1) month, the employee can choose to opt out of the benefit plan for the remainder of the layoff and must provide timely written notice to the Employer of same; and
(iv) if the employee chooses to maintain his or her benefits after the first month, if the employee does not provide the Employer with the necessary funds to cover one hundred percent (100%) of the premium cost of their group benefit plan then any remaining premium amounts will be deducted from the employee’s first pay period following the layoff or, if applicable, from any statutory amounts owed to the employee, subject to a maximum of three (3) months’ premiums.
15.06 In the event that there are insufficient volunteers of a closure of a program as provided for in the classification / shift / department who volunteer for the layoff, employees in the classification will be sent home in reverse order of seniority.
14.2 If a layoff in excess of one full shift is anticipatedArticle 15.05, the Employer will agrees to meet to inform with the Union as far in advance as possible to discuss the employee affected and to discuss methods of reducing the impact.
15.07 It is practicablethe duty of the employees on the recall list to notify the Employer of any change of address or telephone number.
15.08 The Employer agrees to provide both the employees and the Union with as much notice as possible of pending layoffs. Notice of Layoff shall be in accordance with Where circumstances permit, the Employment Standards Act, R.S.O. 2000, as amended. However where the layoff is in excess of Employer agrees to make best efforts to provide at least one (1) full shiftmonth’s notice prior to the layoff.
15.09 Provided that the Employer is given more than six (6) months’ notice, the Company Employer shall give employees, seven the Union six (76) calendar daysmonths’ notice of layoffin writing in the event the Employer is planning, except for or the reasons specified in Article 21. 17.05 Notice of recall must be sent by registered mail to the Employee’s last known address. The return to work date must be no sooner than fourteen (14) calendar days from the date of mailing. If the Employee fails to appear for the return date, the Employee will forfeit his or her recall rights, unless the Employee has rescheduled the return date with the Employer’s consent.
17.06 It shall be the duty of the Employee to notify the Employer promptly of any change of address. Should an Employee fail to do so the Employer shall not be responsible for the failure of any notices which may be required under the terms of this Agreement to reach the Employee.
17.07 Upon written application, the Employer may grant an Employee permission to postpone recall rights for an agreed period of time. Following approval by both Employer and the Union, the Employee will be informed in order writing of senioritythe decision.
17.08 Recall rights will lapse twelve (12) months after the date of layoff, assuming a layoff lasts no longer than 12 months. Should a lay off last longer than 12 months, recall rights shall be extended to lapse eighteen (18) months after the date of layoff, or as otherwise negotiated by the Employer and the Union.
17.09 Grievances concerning layoffs and recalls shall be initiated at Step Two of the grievance procedure.
17.10 The Employer agrees to continue to pay its share of premiums for Employees’ Benefit Plans (as defined in Article 11.02(ii)) on behalf of Employees on layoff who have maintained their recall rights for a period of thirty (30) days or less. Employee contributions for such plans shall be deducted from the last pay cheque.

16.03 An Employee laid off in one classification will be given the opportunity of displacing another Employee with less seniority in a similar or lower classification, provided he/she possesses the ability to perform the job upon completion of a thirty (30) working day familiarization period.
16.04 The following is the process/procedure when reducing the workforce for greater than one (1) day:

a) The number of , employees to be laid off affected will be identifiedplaced by the Company; in the job of the most junior employee provided they have the ability to perform the required work on the following basis: (Skilled Trades excepted) 1st - In his own classification/shift, 2nd - In his own department, 3rd - In the Plant An employee can displace an employee in a higher pay classification provided they have the ability to perform the required work. Xxxxxx notices Such reduction in the work force will be given consistent with the Company's right to an equal number maintain a workforce of employees in reverse order of seniority.
b) The positions vacated by the junior employees who have been given notice of layoff that must be filled will be identified by the Company. Shift types (8 hour vs. Continental) and shift avail- ability for those vacant positions to be worked will be identified in all classifications and may be filled by remaining employees in said classifications by seniority, pursuant to the Switch Shift Request Form applications on file at the time.
c) Nexttime of lay-off, a list of remaining positions will be created showing the availability within ability to perform the plant due to the overall reduction of the workforcework. This list will be known as the “Job Pool.” Please note: Employees who have not been affected by these reductions because they had the seniority to maintain their positions in the classification cannot be displaced off of their shifts due to the “temporary placement” of workers from outside the classification. However, these employees may be moved temporarily to help with training for a reasonable amount of time. Thereafter, they will be returned to their shifts, in accordance with their seniority.
d) Xxxx identified in the Job Pool will be offered by seniority to the employee(s) who are displaced from their respective classifications, but still maintain enough seniority to remain at work.
e) If any temporary job Temporary Job postings are being filled at the time of such layoff, they will be reduced first. When more than one temporary posting in said classification placing employees, the Company will give employees shift preference by seniority provided such opening exists, they will subject to the right of the company to reasonably balance the level of experience on each shift. The Plant Chairperson / Committeeperson / Xxxxxxx shall be reduced given the opportunity to be present while employees are exercising their bumping rights. It is agreed and understood that such qualified employee(s) may require some minor orientation. This period may be extended by senior may, junior mustmutual agreement.
f) In the case where a Continental shift is eliminated the classification will be realigned by seniority.
14.4 14.04 When recalling an employee after layoff, the employee shall be notified personally, or, if personal contact is not made, by registered mail. The employee shall be allowed eight (8) consecutive working days from the date of the personal notice or registration date to report for work. All calls will be made in the presence of a Union Representative. The employee is responsible for providing their current address and phone numbers and emergency contacts to the Human Resources Department at all times. A copy of the registered letter will be provided for the Plant Chairperson at the time of mailing.
14.5 14.05 a) Employees will shall be recalled from layoff in order of seniority, provided they have the ability to perform the required work.
