Xxxxxxxx Facilities. The toilet rooms, toilets, urinals, wash bowls and other apparatus shall not be used for any purpose other than that for which they were constructed and no foreign substance of any kind whatsoever shall be disposed of therein. Tenant will be liable for any breakage, stoppage or damage resulting from the violation of this rule by Tenant, its employees or invitees.

Xxxxxxxx Facilities. Xxxxxxxx shall provide Provider with the use of and access to the Xxxxxxxx Facilities (or equivalent space) described in SCHEDULE O.1 (for the periods specified in a space plan to be developed and mutually agreed to by the Parties during the Transition Period) solely as necessary for Provider to perform its obligations under this Agreement at no cost to Provider. Except as set forth in a SCHEDULE O.1 or as otherwise agreed to by the Parties, all Xxxxxxxx owned or leased assets provided for the use of Provider under this Agreement shall remain in Xxxxxxxx Facilities. In addition, all improvements or modifications to Xxxxxxxx Facilities requested by Provider shall be (i) subject to review and approval in advance by Xxxxxxxx, (ii) in strict compliance with Xxxxxxxx'x then-current policies, standards, rules and procedures, and (iii) performed by and through Xxxxxxxx at Provider's expense. Xxxxxxxx shall own all improvements or modifications to Xxxxxxxx Facilities. Provider acknowledges and agrees that the facilities to be provided by Xxxxxxxx are sufficient for performing the Services and for satisfying Provider's responsibilities under this Agreement. THE Xxxxxxxx FACILITIES ARE PROVIDED BY Xxxxxxxx TO Provider ON AN AS-IS, WHERE-IS BASIS. Xxxxxxxx EXPRESSLY DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE Xxxxxxxx FACILITIES, OR THEIR CONDITION OR SUITABILITY FOR USE BY Final Confidential and Proprietary Information of IBM and Xxxxxxxx PROVIDER.
