The Borrower declares the following: • No claims are pending, or in process, against the Borrower, and no action, suit or proceeding is threatened, pending or in process against the Borrower or his/her property which could adversely affect the Borrower’s financial situation; • The Borrower is not in default under the contracts to which he/she is a party; • The Borrower is not in arrears in his/her income tax payments or in any other taxes or remittances that he/she is legally bound to pay to a government authority; and • The Borrower has the requisite power and capacity to enter into this Loan Agreement and to comply with the obligations stipulated herein.
