Your Statutory Rights. This Licence Agreement gives you specific legal rights and you may also have other rights that vary from one country to another. Some jurisdictions do not allow the exclusion of implied warranties, or certain kinds of limitations or exclusions of liability, so the limitations and exclusions included in this Licence Agreement may not apply to you. Other jurisdictions do allow limitations and exclusions subject to certain conditions. In such a case the limitations and exclusions included in this Licence Agreement shall apply to the fullest extent permitted by the laws of such applicable jurisdictions. If any part of the limitations or exclusions in this Licence Agreement is held to be void or unenforceable, such part shall be deemed to be deleted from this Licence Agreement and the remainder of the limitation or exclusion shall continue in full force and effect. Any rights that you may have as a consumer (i.e. a purchaser for private as opposed to business, academic or government use) are not affected.
Your Statutory Rights. The Guarantee is not intended to replace, modify or be a substitution for your statutory rights and Jewelultra Ltd shall not be responsible for any loss, damage, costs, expenses or otherwise which may be incurred as a direct or indirect result of your purchase of the treatment.

Your Statutory Rights a. Your rights in this User Agreement are in addition to any rights you have as a consumer under the Australian Consumer Law. You can generally find out more about consumer rights from consumer organisations and bodies such as the Australian Competition and Consumer Commission and State or Territory fair trading authorities.
b. There are a number of consumer guarantees in the Australian Consumer Law which do not apply to the sale of goods by auction that is conducted by an agent. These are, in the Australian Consumer Law, at: i. section 54, relating to acceptable quality;

10.2 Our Goods and Services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the Services, you are entitled:
(a) to cancel these Terms with us; and
(b) to a refund for the unused portion, or to compensation for its reduced value.
10.3 You are also entitled to choose a refund or replacement for major failures with Goods. If a failure with the Goods or a Services does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the Goods and to cancel the contract for the Services and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the Goods or Services.
10.4 If the ACL applies to you as a consumer, nothing in these Terms excludes your Statutory Rights as a consumer under the ACL. You agree that our Liability for the Goods and Services provided to an entity defined as a consumer under the ACL is governed solely by the ACL and these Terms.
