Limited Hardware Warranty. Check Point's warranty for Hardware products is described in the Limited Hardware Warranty page attached to this Agreement.
Limited Hardware Warranty. 1. Except as otherwise provided by applicable law, or as agreed with OneSpan pursuant to a separate agreement, OneSpan warrants that for a period of ninety (90) days following Your receipt of the OneSpan Hardware, the OneSpan Hardware will be free from faults in manufacture and materials as described in the OneSpan warranty documentation included with shipment of the OneSpan Hardware. OneSpan does not warrant that the OneSpan Hardware will operate uninterrupted or error-free. OneSpan will not be liable for defects in the OneSpan Hardware notified by You after expiration of the warranty period.
2. If any defective OneSpan Hardware is to be returned pursuant to this Agreement, OneSpan will, in its discretion, provide You or the authorized reseller from whom You acquired the OneSpan Hardware with a Return Material Authorization (“RMA”) number. OneSpan will examine the returned OneSpan Hardware and notify You or the authorized reseller of: (i) the part of the OneSpan Hardware covered by the limited warranty set forth in this Section I, and (ii) the part of the OneSpan Hardware not covered by this limited warranty and the reason therefor. For OneSpan Hardware not covered by the limited warranty but can be reworked (i.e. new label, erasure of all data), OneSpan will, in its discretion, submit an offer to You, directly or through the authorized reseller, to rework the OneSpan Hardware.
3. In case of breach of the warranty set forth in this Section I or other duty related to quality, OneSpan will, at its option, repair or replace the OneSpan Hardware according to the applicable warranty documentation. You agree to the use of remanufactured or refurbished OneSpan Hardware subject of such repair or replacement. If OneSpan determines that repair or replacement is not practicable, You may return the OneSpan Hardware to OneSpan or, as directed by OneSpan, to the authorized reseller in exchange for a refund of the price actually paid for the defective item less depreciation based on a three (3) months straight line depreciation schedule. You acknowledge that this Section I sets forth Your exclusive remedy and OneSpan’s exclusive liability for any breach of warranty related to the quality of the OneSpan Hardware.
Limited Hardware Warranty. We warrant to you and only you that the following Trimble-Provided Hardware will conform substantially to the manufacturer’s published specifications for a period of thirty (36) months from the date of shipment:
Limited Hardware Warranty. Any warranties listed in the Master Agreement or Schedules shall not apply and this warranty contained within this Section 4.2 shall apply to hardware purchases.

Limited Hardware Warranty. If you have purchased Hardware under this Agreement, we warrant that the Hardware will, for a period of three (3) years from the date of delivery of the Hardware to you (the “Warranty Period”), be free from defects in material and workmanship under normal use. As your sole and exclusive remedy, and our sole and exclusive liability, for any breach of this warranty, we shall, at our option and expense, (a) repair or replace the non-conforming Hardware, or (b) issue you a credit or refund in the amount of the purchase price for such Hardware; provided that (i) we are notified in writing by you within thirty (30) days after discovery of such failure; (ii) you obtain an RMA from us prior to returning any defective Hardware to us; (iii) the defective Hardware is returned to the location specified by us; (iv) the defective Hardware is received by us not later than four (4) weeks following the last day of the Warranty Period; and (v) our examination of such Hardware discloses that such failures have not been caused by improper installation by or application, repair, alteration, accident or negligence. Any such repair, replacement or return of the Hardware provided to you will not extend the original warranty. The foregoing limited warranty extends only to the original Customer who purchases the Hardware under this Agreement (and not to any subsequent purchasers or third parties). The foregoing limited warranties shall be null and void to the extent the Hardware: (1) has been altered or serviced, except by us or one of our authorized service providers; (2) has not been installed, operated, repaired, or maintained in accordance with our instructions; (3) is used for an unintended purpose, is used other than in accordance with its published documentation or specifications, or is otherwise used in breach of this Agreement; (4) fails to conform with this warranty as a result of its use with any third-party hardware or software; (5) has been subjected to abnormal physical or electrical stress, misuse, negligence or accident; or (6) has been damaged or rendered defective by the use of parts not manufactured or sold by us.
Limited Hardware Warranty. Check Point warrants that the hardware components of its Hardware Product shall be free from material defects in design, materials, and workmanship and will function, under normal use and circumstances, in accordance with the documentation provided, for a period of one (1) year from the date of activation of the Hardware Product. If the Hardware Product has not been activated, the warranty will be valid for fifteen (15) months from the date of Check Point’s shipment of the Hardware Product (“Warranty Period”). After the Warranty Period, certain return material authorization (“RMA”) services, as provided by Check Point (which are not covered under this warranty), are available for all Hardware Products pursuant to a purchased and active Check Point support agreement. Your sole and exclusive remedy, and Check Point’s sole and exclusive liability for defective hardware components, shall be that Check Point, subject to the terms and conditions of this Section 1, and solely upon confirmation of a defect or failure of a hardware component to perform as warranted, shall at its sole option, either repair or replace the nonconforming hardware component or return of the price paid for the Hardware Product. All replacement parts furnished to you under this warranty shall be refurbished and equivalent to new, and shall be warranted as new for the remainder of the original warranty period. If a hardware failure occurs in the first 30 days from the product’s software activation, Check Point will replace it with new part or full unit as may be needed. All defective parts, which have been replaced, shall become the property of Check Point. All defective parts that have been repaired shall remain Your property. This warranty gives You specific legal rights. You may have other rights that vary from state to state.
Limited Hardware Warranty. The Hardware is sold with a limited term warranty as specified in the Agreement, commencing from the date the Hardware is available for EXW (Incoterms 2010), delivery, against defects or malfunction in normal use for which the Hardware was intended. MobileDOCK warrants that the Hardware conforms to the published specifications for the Hardware and that it is free of defects in materials or workmanship. In the event of a claim for warranty service, Customer shall advise MobileDOCK of the warranty claim with a written description of the problem and the serial number of the Hardware and shall return the Hardware, at the Customer’s expense, to the address specified by MobileDOCK for repair or replacement. This warranty shall be void if it is determined that the Hardware has been subject to abuse, used in an environment beyond the manufacturer specifications, or if the defect or malfunction is due to incorrect installation by Customer. MobileDOCK’s entire liability for the Hardware and the Customer’s sole and exclusive remedy in connection with this warranty shall be at MobileDOCK discretion to either (i) repair, or (ii) replace the Hardware in accordance with the foregoing, or, (iii) if MobileDOCK determines that neither repair or replacement is economically viable, then a refund of the purchase price less deduction for fair wear and tear by means of depreciation of the original Hardware purchase price depreciated on a straight line basis over a 36 month period from original date of purchase.
Limited Hardware Warranty. Any warranties listed in the Master Agreement or Schedules shall not apply and this warranty contained within this Section 7.2 shall apply to hardware purchases.
