COMPLAINTS AND RETURNS. 12.1 Společnost ručí Kupujícímu za jakost Výrobků a za jejich skryté vady během doby použitelnosti Výrobků.
COMPLAINTS AND RETURNS. 6.1 If Buyer receives complaints from patients, doctors, nurses or other healthcare professionals regarding any Products, it shall as soon as possible send written notification thereof in English both by fax and by registered or certified mail to Amgen Customer Service at Amgen Breda Logistics Center, Minervum 0000, XX-0000 XX Xxxxx, Xxx Xxxxxxxxxxx, +00 00 000 0000. For any Products returns, Buyer shall promptly contact Amgen Customer Service at Amgen Breda Logistics Center, Minervum 0000, XX-0000 XX Xxxxx, Xxx Xxxxxxxxxxx, tel. +00(0)00.000.0000, email xx-xxx@xxxxx.xxx, and, if directed by Amgen, at Amgen’s local customer service contact. Returnable Products shall include any unused partial or full pack quantities, or Products received in error or damaged in transit, provided that, unless otherwise expressly agreed by Amgen, no credit or replacement Products shall be issued by Amgen in the case of Products returns resulting from: (i) any Products expiration, so long as Amgen supplied Buyer with Products with a minimum shelf life of at least three (3) months, (ii) improper storage, or other conditions beyond Amgen’s control, or (iii) Products obtained other than through Amgen’s authorized channel of distribution. Except as otherwise provided in this Agreement, Buyer shall have no other regulatory obligations (including pharmacovigilance) with respect to the supply by Amgen of the Products to Buyer under this Agreement. 6.2 Amgen (or the designated Amgen Group member) shall have sole authority for any decision to recall any Products. Buyer shall cooperate with Amgen in the case of any recall of Products, including providing full support to deliver requested information to Amgen and any designated Amgen Group member (e.g. track trace reports) and in taking all necessary steps to remove the relevant batch from the market place at Amgen’s cost. In order to facilitate any possible batch recall, Buyer shall maintain suitable records including at least associated batch numbers and all the quantities in respect of all sales together with appropriate details of its customers and all other information required pursuant to any relevant law or regulation. If Buyer is required by any government agency or regulatory body acting within its proper authority to initiate or undertake a batch recall, it must immediately provide Amgen with written notice of such requirement. COMPLAINTS AND RETURNS. 12.1 The Company is liable towards the Buyer for quality of the Products and for their hidden defects during the usable life of the Products. 12.2 When signing for the Products from the forwarder, the Buyer will check that the number of delivered Product packages corresponds to the number on indicated in the delivery note and shall immediately record any numerical discrepancy or obvious external damage to the Products on the forwarder's delivery note. 12.3 The Company will handle any claims regarding apparent external damage, missing quantity, or incorrect supplies of the Products only if such claim has been communicated by the Buyer by registered letter within two (2) calendar days from Products delivery. Any complaints regarding failure to deliver the Products will be handled by the Company only if communicated by the Buyer by registered letter within ten (10) calendar days from the estimated delivery date and claims regarding hidden defects will be received and handled only if communicated to the Company by registered letter within two (2) calendar days from the day when such defects were or could have been identified. All supporting documents, based on which the Buyer's claim is based, should be attached. The Company's liability for any such complaint will be limited to the price of the Products. The Company may - at its sole discretion - decide about the way of handling the claim. The company may opt to: (a) reimburse the price of the defective Products or; (b)
