Common use of Limitation of Liability Clause in Contracts

Limitation of Liability. 12.1 If the Party is a Consumer, the Proprietor shall not be held liable for slight negligence except in cases of bodily injury. 12.2 If the Party is an Entrepreneur, the Proprietor shall not be held liable for slight or gross negligence. In such event, the Party shall bear the burden of proof for demonstrating fault. No consequential, non-material or indirect damage and no loss of profit shall be reimbursed. The damage to be reimbursed shall always be limited to the amount of the damage incurred as a result of relying on the Agreement (Vertrauensinteresse).
