Agricultural employer definition

Agricultural employer means any person who owns or operates a farm, ranch, processing establishment, can- nery, gin, packing shed or nursery, or who produces or conditions seed, and Wage and Hour Division, Labor § 500.20 who either recruits, solicits, hires, em- ploys, furnishes, or transports any mi- grant or seasonal agricultural worker. Produces seed means the planting, cul- tivation, growing and harvesting of seeds of agricultural or horticultural commodities. Conditions seed means the in-plant work done after seed produc- tion including the drying and aerating of seed.
Agricultural employer means any person, including the state and its political subdivisions, who engages the services of any employee to perform agricultural labor. If any employee is present at the workplace of an agricultural employer under an agreement between that agricultural employer and another agri- cultural employer or employer, “agricultural employer” means the agricultural employer with control or custody of a pesticide. An agricultural employer who engages some employees to per- form agricultural labor and other employees for other purposes is only an agricultural employer with respect to the employees engaged to perform agricultural labor.
Agricultural employer means a person who employs agricultural labor as defined in Subsections 35A-4-206(1) and (2) and does not include employment as provided in Subsection 35A-4-206(3).
