Capacity Contract definition

Capacity Contract means a contract entered into by the Secretary and an eligible entity for the right to the use of the transmission capacity of an eligible project.
Capacity Contract means a contract where the capacity of a generating station is contracted in advance wherein the generating station is obligated to despatch contracted electricity as and when required by such buyer during the tenure of the contract and consideration by way of capacity payment is made by the buyer;

  • No Party shall be entitled to disclose Confidential Information to any third party without the prior written consent of the other Party, except to appropriate governmental authorities or to Arbitrators under this Capacity Contract or when required by mandatory law or regulations.

  • The Confidential Information may be disclosed to advisors, contractors, banks or other financing entities and employees of the Parties only to the extent required for the proper performance of the obligations arising out of this Capacity Contract.

  • Notwithstanding the payment adjustments described in the foregoing and for avoidance of doubt, if there is no change in the values calculated for the Contract Nameplate Capacity, Contract Capacity Factor and Contract Price between a given period and the subsequent period, then there shall be no payment adjustments pursuant to this Section 2.6(a).

  • System User agrees automatically with the final confirmation of the partial Assignment by TSO that as of the effective date of such assignment to the assignee this Capacity Contract is amended accordingly to reflect the assignment.

  • The offered Balance Group Management service has been implemented pursuant to the provisions of the Austrian Natural Gas ▇▇▇ ▇▇▇▇, the Other Market Rules (Sonstige Marktregeln, SoMa), the General Terms and Conditions for Transmission Network Access of TAG GmbH and the Capacity Contract stipulated between the System User and TAG GmbH.

  • In such event, the corresponding amendments to the Quality Specification shall be forthwith applied also for the purpose of this Capacity Contract.

  • The System User shall acknowledge the version of the General Terms and Conditions for Transmission Network Access applying at date of signing of this Frame Capacity Contract and published on the Internet, and confirm acceptance thereof.

Capacity Contract means a transport contract between a transmission system operator and a network user;

  • EPC Contract means the Seller’s engineering, procurement and construction contract with the EPC Contractor.

  • Capacity Charge means a charge for public facilities in existence at the time a charge is imposed or charges for new public facilities to be acquired or constructed in the future that are of proportional benefit to the person or property being charged, including supply or capacity contracts for rights or entitlements, real property interests, and entitlements and other rights of the local agency involving capital expense relating to its use of existing or new public facilities. A “capacity charge” does not include a commodity charge.

  • Capacity Interconnection Rights means the rights to input generation as a Generation Capacity Resource into the Transmission System at the Point of Interconnection where the generating facilities connect to the Transmission System.
