Cash Settlement Benefits definition

Cash Settlement Benefits means the maximum amount of up to $19,850,000.00 in cash that Defendants agree to make available to pay Settlement Class Members who timely submit a claim under the Settlement, and to pay any Class Counsel Fee Award. The Cash Settlement Benefits will be the maximum made available by Defendants for all Settlement Class Member Payments, Class Counsel Fees, and all other fees or costs of any kind, with the exception of settlement administration costs and Service Award, which Defendants will pay for separately.
Cash Settlement Benefits means the maximum amount of up to $13,597,625.00 in cash that Defendants agree to make available to pay Settlement Class Members who timely submit a claim under the Settlement. The Cash Settlement Benefits will be the maximum made available by Defendants for all Settlement Class Member Payments.
Cash Settlement Benefits means the $2,291,738.00 in cash that Defendant agrees to make available to pay Settlement Class Members who timely submit a claim under the Settlement, and to pay Class Counsel Fees and additional payment to the Named Plaintiff. Examples of Cash Settlement Benefits in a sentence

  • The attorneys’ fees request, which shall be paid by Grange separately from the Cash Settlement Benefits, is equal to 20% of the maximum Cash Settlement Benefits.

  • Class Counsel will seek attorneys’ fees and costs of up to $1,590,500 to be paid out of the Cash Settlement Benefits and a $5,000 Payment to the Class Representatives.

  • Any award of attorneys’ fees to Class Counsel shall be payable separate and apart from the Cash Settlement Benefits available to Settlement Class Members, thereby ensuring that the Settlement Class Members receive 100% of their claimed losses.

  • The maximum available Cash Settlement Benefits totals $5,100,000 for all Settlement Class Members.

  • The attorneys’ fees request, which shall be paid out of the Cash Settlement Benefits, is equal to approximately 29.5% of the maximum Cash Settlement Benefits.

Cash Settlement Benefits means the maximum amount of $12,667,804.00 in cash that Grange agreed to pay Settlement Class Members who timely submit a claim under the Settlement. The Cash Settlement Benefits will be the maximum made available by Grange for Settlement Class Member Payments.

Related to Cash Settlement Benefits

  • Cash Settlement shall have the meaning specified in Section 14.02(a).

  • Cash Settlement Amount means the “Cash Settlement Amount” as determined by the Calculation Agent in accordance with Paragraph 6.

  • Cash Settlement Date means, for each Financially Settled Futures Transaction, the Business Day determined by Exchange from time to time in accordance with industry practice for such Transaction, as posted on Exchange’s Website not less than one month prior to the occurrence of such date, other than Invoices issued as a result of a Contracting Party’s Default or under the Close- out Procedure which amounts require payment immediately;

  • Gross Settlement Amount means $633,000.00 which is the total amount Defendant agrees to pay under the Settlement except as provided in Paragraph 9 below. The Gross Settlement Amount will be used to pay Individual Class Payments, Individual PAGA Payments, the LWDA PAGA Payment, Class Counsel Fees, Class Counsel Expenses, Class Representative Service Payment and the Administrator’s Expenses.

  • Cash Settlement Averaging Period means, with respect to a Security that is tendered for conversion in accordance with this Article X, the twenty (20) consecutive Trading-Day period that begins on, and includes, the third (3rd) Trading Day after the Conversion Date for such Security; provided, however, that if such Conversion Date is on or after the twenty third (23rd) scheduled Trading Day prior to the Maturity Date, then the Cash Settlement Averaging Period with respect to such conversion shall be the twenty (20) consecutive Trading-Day period that begins on and includes the twentieth (20th) scheduled Trading Day prior to the Maturity Date.

  • Maximum Settlement Amount means $500,000,000 as amended or modified in accordance with Appendix E.

  • Net Settlement Amount means the Gross Settlement Amount, less the following payments in the amounts approved by the Court: Individual PAGA Payments, the LWDA PAGA Payment, Class Representative Service Payment, Class Counsel Fees Payment, Class Counsel Litigation Expenses Payment, and the Administration Expenses Payment. The remainder is to be paid to Participating Class Members as Individual Class Payments.

  • Retirement Benefits means benefits paid by reference to reaching, or the expectation of reaching, retirement or, where they are supplementary to those benefits and provided on an ancillary basis, in the form of payments on death, disability, or cessation of employment or in the form of support payments or services in case of sickness, indigence or death. In order to facilitate financial security in retirement, these benefits may take the form of payments for life, payments made for a temporary period, a lump sum, or any combination thereof;

  • Retirement Benefit means the benefit set forth in Article 5.

  • Early Settlement Amount has the meaning specified in Section 5.9(a).

  • Termination Benefit means the benefit set forth in Article 7.

  • Physical Settlement Amount For any Settlement Date for which Physical Settlement is applicable, an amount in cash equal to the product of (a) the Forward Price in effect on the relevant Settlement Date multiplied by (b) the Settlement Shares for such Settlement Date.

  • Structured settlement annuity means an annuity purchased in order to fund periodic payments for a plaintiff or other claimant in payment for or with respect to personal injury suffered by the plaintiff or other claimant.

  • Individual Settlement Payment means the amount payable from the Net

  • Termination Benefits means the benefits described in Section 4.1(b).

  • Early Retirement Benefit means the retirement benefit payable to a member following early

  • Disruption Cash Settlement Price means in respect of each Security, an amount in the Settlement Currency equal to the fair market value of the Share Amount (taking into account, where the Settlement Disruption Event affected some but not all of the Shares comprising the Share Amount and such non-affected Shares have been duly delivered as provided above, the value of such Shares), less the cost to the Issuer of unwinding any underlying related hedging arrangements, all as determined by the Issuer.

  • Scheduled Settlement Date means a date on which a payment or delivery is to be made under Section 2(a)(i) with respect to a Transaction.

  • Share Termination Settled in relation to the Transaction means that the Share Termination Alternative is applicable to the Transaction.

  • Net Share Settlement Amount For any Settlement Date, an amount equal to the product of (i) the number of Warrants exercised or deemed exercised on the relevant Exercise Date, (ii) the Strike Price Differential for the relevant Valuation Date and (iii) the Warrant Entitlement.

  • Gross Settlement Fund means the Settlement Amount plus all interest earned thereon.

Beginning on the thirteenth month that the Normal Retirement Benefit is paid, and continuing thereafter until paid in full, the Normal Retirement Benefit shall be increased annually by three percent (3%) from the previous year’s Normal Retirement Benefit amount to account for cost of living increases.

  • Early Termination Payment is defined in Section 4.3(b) of this Agreement.
