Settlement Administration Costs. The Court has approved Phoenix Settlement Administrators. to act as the “Settlement Administrator,” who is sending this Notice to you and will perform many other duties relating to the Settlement. The Court has approved setting an amount not to exceed $35,500.00 from the Gross Settlement Amount to pay the Settlement administration costs. Attorneys’ Fees and Expenses. Class Counsel have been prosecuting the Lawsuit on behalf of the Settlement Class Members on a contingency fee basis (that is, without being paid any money to date) and have been paying all litigation costs and expenses. The Court will determine the actual amount awarded to Class Counsel as attorneys’ fees, which will be paid from the Gross Settlement Amount. Settlement Class Members are not personally responsible for any of Class Counsel’s attorneys’ fees or expenses. Class Counsel will ask for fees of up to one-third of the Gross Settlement Amount, which is estimated to be $450,000.00, as reasonable compensation for the work Class Counsel performed and will continue to perform in this Lawsuit through Settlement finalization. Class Counsel also will ask for reimbursement in an amount not to exceed $25,000.00 for verified costs Class Counsel incurred in connection with the Lawsuit. Service Award to Class Representative. Class Counsel will ask the Court to award the Class Representative a service award in the amount not to exceed $5,000.00, to compensate him for him service and extra work provided on behalf of the Settlement Class Members.
Settlement Administration Costs. Settlement Administration costs are estimated not to exceed $17,500.00 and shall be paid from the Gross Settlement Amount. A copy of the Settlement Administrator’s invoice shall be provided to the Court with Plaintiffs’ Motion for Final Approval of Class Action Settlement. The Parties agree to cooperate in the settlement administration process and to make all reasonable efforts to control and minimize the costs incurred in the administration of the Settlement.
Settlement Administration Costs. The Settlement Administrator shall be paid for the costs of administration of the Settlement from the Maximum Settlement Fund. The estimate of the Settlement Administration Costs is not to exceed Twelve Thousand Dollars ($12,000.00). Plaintiffs and Class Counsel 7 will be responsible for drafting the motion seeking Final Approval of the Settlement. Class Counsel will 8 provide Defendants’ Counsel a draft of the Final Approval Motion before the filing deadline. By way 9 of said motion, Plaintiffs will apply for the entry of the mutually-agreed upon proposed order and 11 following:

Class Counsel will ask the Court to award the Class Representative, Xxxxx Xxxxxx, a service award in the amount of $10,000.00, to compensate him for his services and extra work provided on behalf of the Settlement Class members.

The amount remaining after these items are paid, if any, is the “Net Settlement Fund.” The Net Settlement Fund will then be used to make automatic Settlement Class Member Payments (an account credit or payment by check) to all Settlement Class Members who do not request exclusion from the Settlement Class. Payments to each Settlement Class Member will be distributed on a pro rata (a legal term meaning equal) basis and calculated as follows: (Net Settlement Fund divided by the Total Amount of Class Fees of Settlement Class Members) x (Total Amount of Class Fees [meaning overdraft fees covered by the Settlement that were assessed to your Account and not refunded] you as an individual Settlement Class Member were charged and paid in connection with the transactions at issue) = Settlement Class Member Payment.
Settlement Administration Costs. 35. Ninety eight thousand and five hundred and eight dollars ($98,508.00) from the Gross Settlement Amount shall be paid to the Settlement Administrator, without further approval from Blue Shield or further order of the Court, for reasonable Settlement Administrative Expenses actually incurred.
