Certificate of Total Performance definition

Certificate of Total Performance means a certificate issued indicating that the Work has been achieved;

Certificate of Total Performance means, subject always to section 5.3 of the Agreement and to the warranty under GC.51, a certificate issued by the Engineer accepting the Contractor’s certification that the entire Work of the Contract has been performed by the Contractor to the requirements of the Contract Documents;

Certificate of Total Performance means the certificate issued by the Owner’s Representative, when to the best of his knowledge, information and belief, the entire Work has been performed to the requirements of the Contract Documents, except for defects in the Work not discovered by the Owner’s Representative and the making good of faulty workmanship or materials during the maintenance period.

Examples of Certificate of Total Performance in a sentence

• The Contractor's application for the Certificate of Total Performance shall constitute a waiver and release by the Contractor of any and all claims arising out of or relating to the Contract that have arisen between the date of Substantial Performance and the date of the Certificate of Total Performance.

• This Warrant does not create and shall not be construed as creating any rights enforceable by any other person or corporation.

• The issuance of the Certificate of Total Performance shall constitute a waiver of all claims by the Owner against the Contractor, except those previously made in writing and still unsettled, if any, and those arising from any warrant, or those arising from negligence on the part of the Contractor.

• Performance deposit will be released upon issuance of Certificate of Total Performance of Work.

• The acceptance of the Certificate of Total Performance or of the payment due thereunder shall constitute a waiver of all claims by the Contractor against the Owner except those made in writing prior to the Contractor’s application for payment upon Total Performance of the Contract and still unsettled, if any.

• When the Engineer/Architect finds the Work to be totally performed to his satisfaction he shall issue a Certificate of Total Performance and certify for payment the remaining monies due to the Contractor under the Contract less any holdback monies which are required to be retained.

More Definitions of Certificate of Total Performance

Certificate of Total Performance means a certificate issued by the Consulting Engineer in accordance with Section 10.2 of this bylaw, certifying that Total Performance of all of the Works and Services has been achieved.” And replacing it with:
