Clauses 3. 4.6 through 3.4.10 of this article shall be applicable only to teachers whose date of hire is on or after the effective date of this agreement.
Clauses 3. 2.2 and 3.2.3 are not applicable to customers who choose the Monthly Subscription option.
Clauses 3. 4.6 through 3.4.9 of this article shall be applicable only to teachers whose date of hire is on or after the effective date of this collective agreement.
1. a) Opportunity room teachers, and academic and vocational counsellors receiving an additional allowance, shall continue to receive this allowance providing, however, that the teacher was a recipient of such an allowance on or before December 31, 1977.

Clauses 3. 3.1 to 3.3.4 (Realisation of assets) (inclusive) shall not apply following the date on which LFSL, in conjunction with the Scheme Supervisors, determines, acting reasonably that:
(a) no further Cash proceeds are likely to be available for payment to the Settlement Account; or
(b) the costs and expenses of realising LFSL's assets would be likely to exceed the Cash value of such assets, in which case all of LFSL's assets and the Trust Assets (other than the amounts standing to the credit of the Settlement Account) will cease to be Trust Assets, and will be held by LFSL absolutely and free and clear of the Trust.
Clauses 3. 1.2 to 3.1.4 (inclusive) will not apply to the matters referred to in paragraphs (b) to (e) (inclusive) of the definition of Confidential Information set out in clause 1.1.
Clauses 3. 4.6 through 3.4.9 of this Article shall be applicable only to teachers whose date of hire is on or after the effective date of this agreement. When the School Division employs a retired teacher to occupy a vacancy that is expected to be less than twenty (20) consecutive teaching days in duration and the teacher is designated to an administrative, supervisory, or consultative position, the parties agree to the following:
1. The teacher shall be paid one two-hundredth (1/200th) of the annual salary in Article 3 for each day of work.
2. The teacher shall be paid one two-hundredth (1/200th) of the annual allowance in Article 4 for each day of work, based on the administrative, supervisory, or consultative position the teacher is designated to perform.
3. Should a teacher be unable to work as a result of an injury sustained while performing their duties for the School Division, the teacher shall be paid an amount of money equal to the per diem rate specified in this letter up to a maximum of twenty
Clauses 3. 4.1(a) and (b) shall not apply to employees holding an Appendix Ill position.
